    Gavin Newsom and Sirhan’s Parole


    Today, California is one of only three states in which the governor has the ability to overrule a parole board decision.  Which means he has a political veto over a deliberative process. The other two states are Oklahoma and Maryland.  In Maryland, a bill is advancing through the legislature which would eliminate the gubernatorial veto.  And the citizens of the state support the change overwhelmingly.  I sincerely hope the same thing now happens in California.

    Since taking office in March of 2019, Governor Gavin Newsom has used this discretionary power rather often. To be exact, 46 times. On January 13th he again overruled the parole board, this time in the case of Sirhan Sirhan. In fact, on that day, Newsom wrote an editorial for the LA Times about his decision. He began that column by saying, “… Sirhan assassinated Sen. Robert F. Kennedy just moments after Kennedy won the California presidential primary.” He then added that, “Decades later, Sirhan refuses to accept responsibility for the crimes.”

    He then stated what is likely the real reason for reversing the parole board. He mentioned that his murder left RFK’s “eleven children without a father and his wife without a husband.  Kennedy’s family bears his loss every day.” The Kennedy family made an extraordinary effort to keep Sirhan behind bars––in spite of the parole board’s verdict. They seem to have arranged a multi-platformed media crusade to both counter the parole board decision and also to neutralize the efforts of Robert Kennedy Jr. For he is the only member of that family who has spoken out against the official verdicts in both the John Kennedy and Robert Kennedy cases.

    For instance, Rory Kennedy wrote a piece in The New York Times on September 1st of last year titled, “The Man Who Murdered my Father Doesn’t Deserve Parole.” She  wrote that, “As my father was taken forever, so too should Mr. Sirhan be.”

    The majority of Robert Kennedy’s children––six of them––feel this way, and this helped give political cover to Newsom’s decision to veto the parole board.  The problem with this is dual.  First, the board has rules and guidelines it follows in order to make a decision.  Political advantage and familial vengeance should not be part of that process.  Secondly, as many have noted, Sirhan has served much longer for the charge he was convicted of than the normal term. What is the purpose of keeping him there so much longer when the board has deemed him no danger to society?

    Part of this crusade seems to simply stem from a reaction to RFK Jr’s outspokenness on the issue.  For decades, the policy of the Kennedy family had been not to speak out on the assassinations of either President Kennedy or Senator Kennedy. Bobby Kennedy Jr. changed that pattern. He began speaking out about it back in 2013 during a public appearance with Rory hosted by Charlie Rose in Dallas. (New Haven Register, Associated Press report January 12, 2013) He furthered his ideas on the subject matter with his book American Values in 2018.

    What is so ironic about this is that, as David Talbot’s book Brothers shows, Attorney General Robert Kennedy never bought the cover story about his brother’s death. In fact, within a week of JFK’s murder both Bobby and JFK’s widow, Jackie Kennedy, wrote a letter to the rulers in Moscow saying that they understood that Lee Oswald was simply a front man, and that President Kennedy’s assassination was the work of a large domestic plot. (Talbot, pp. 32-34)

    Somehow, the majority of Robert Kennedy’s children cannot seem to understand this even though their father did. And if this is what Senator Kennedy thought, and he was on the verge of gaining the Democratic nomination, would those who killed President Kennedy hesitate to get rid of him? When, in fact, they murdered his brother while in a motorcade, in broad daylight in front of hundreds of witnesses?

    Many of us have sympathized with the Kennedy family for decades.  After all, Jackie did not even want Bobby to run for the presidency. She feared that what happened to her husband would then happen to him. She was correct.

    But this is now 2022.  Why do we still have a Kennedy family deed of gift for the autopsy materials on John Kennedy? Which means their representative can rule on who sees those exhibits. Why are the notes by William Manchester on his book The Death of a President still ruled off limits to the public? That book was issued in 1967. And now the Kennedy family gets to influence whether or not Sirhan has served enough time in prison? I won’t even argue the idea that Sirhan not only did not but could not have committed the crime, since that should not be argued before the parole board.  Suffice it to say, Sirhan was railroaded by both the LAPD and the DA’s office. Due to his incompetent lawyers, the merits of his case were not argued in court.  In other words, the same thing that happened in the John Kennedy case occurred in the Robert Kennedy case. When Martin Luther King was being legally railroaded in Georgia during the 1960 presidential campaign, the Kennedy brothers intervened. And this showed the difference between them and Richard Nixon.     California is a big, powerful, liberal state. Gavin Newsom just won a smashing victory against a recall effort. He must also be quite aware that former state Attorney General Kamala Harris is now the country’s vice-president. While state AG she had a perfect opportunity to reopen the RFK case.  She decided to fight the petition by Sirhan’s then attorneys Laurie Dusek and Bill Pepper. (see Lisa Pease, A Lie too Big to Fail, pp. 501-02) She understood that any effort to do the right thing in that case would be a detriment to career advancement. She put her finger in the wind and she went to the Senate and then the White House. Newsom clearly recalls the paradigm.

    Angela Berry is a specialist in these types of parole hearings and cases.  She is Sirhan’s present attorney.  She replied that Newsom “had bowed to political considerations in denying her client parole.” She then added that “the legal decision for his release is clear and straightforward.  We are confident that the judicial review of the governor’s decision will show that the governor got it wrong.”  She further asserted that state law holds that inmates are supposed to be paroled unless they pose a current unreasonable public safety risk. Yet “not an iota of evidence exists to suggest Mr. Sirhan is still a danger to society.”  And she noted that prison psychologists and psychiatrists had assessed his case in such a manner. To cinch the case that he poses no threat to society, Sirhan has waived his right to fight deportation. But prison does pose a threat to him, since Berry said he had his throat slashed by another inmate in 2019. (read the story here

    JFK Assassination Records—The Picture is Getting Clearer


    I have written a series of articles for Kennedys and King  regarding the John F. Kennedy Assassination Records Collection Act of 1992 (the “JFK Act”).  The main focus of the previous articles has been the failure of agencies and the Executive Branch to timely release all assassination records by October 26, 2017.  That was the mandated date under the JFK Act for final declassification of all assassination records.  This article will focus on the actual steps taken by agencies and the Executive Branch to delay the process of declassification since 2017. We will also examine what can be done to ensure compliance with the JFK Act at this point in time.

    In recent months, I have been working with a group of skilled lawyers in an effort to determine why, in 2021, the American public still does not have access to tens of thousands assassination records.  Let me say that again.  In 2021, agencies and the Executive Branch are still classifying tens of thousands assassination records: almost 58 years after the Kennedy Assassination.  Even worse, we do not have a valid explanation from the Executive Branch as required by the JFK Act.  We will get back to that point later in the article.

    Brief Early History of the JFK Act and Declassification Efforts

    Congress overwhelmingly passed the JFK Act in October of 1992.  Only one member of Congress did not vote in favor.  The JFK Act required the formation of the Assassination Records Review Board (ARRB): an independent panel of academics, archivists and/or attorneys to begin the declassification process.  In the opening declarations of the JFK Act, Congress made its intent very clear.  Congress stated that all assassination records carried an immediate presumption of disclosure, and that only in the rarest of cases would continued postponement be possibly warranted.  Remember, Congress declared that in 1992, almost 30 years ago.

    The ARRB did a tremendous amount of work between 1994 and 1998.  The result was declassification of thousands of assassination records, which was a significant step for American citizens and researchers who seek to understand the history of the Kennedy Assassination.  It is worth noting that the “Public Interest” was a compelling reason for the creation of the JFK Act.  The JFK Act itself states that the “Public Interest” means the “compelling interest in the prompt public disclosure of assassination records for historical and governmental purposes and for the purpose of fully informing the American people about the history surrounding the assassination of President John F. Kennedy.”

    The ARRB, by Congressional mandate, completed its term by 1998.  Congress then left further declassification efforts in the hands of agencies and the Executive Branch.  That is where we start to see the problem.

    The JFK Act required agencies to engage in a process of “periodic review” after the winding down of the ARRB.  Even if the ARRB had initially determined that an assassination record warranted postponement under the evidentiary standards of the JFK Act, agencies were still required to review those determinations from the 1990’s and “address the public disclosure of additional assassination records.”  The purpose of the “periodic review” by agencies was to continue the downgrade and the declassification of protected assassination records.  Further, for any records initially approved for postponement by the ARRB, agencies were required to deliver to the Archivist (and publish in the Federal Register) an unclassified written description of the reason for continued postponement.

    Brief Explanation of the Mandated Deadline—October 26, 2017

    Agencies and the Executive Branch were given 25 years to complete the declassification process for JFK Records.  As discussed above, this started with disclosures to the ARRB and requests for continued classification.  Then, the agencies had between 1998 and 2017 to complete the declassification process through periodic review and additional disclosures to the Archivist.  As of October 26, 2017, precisely 25 years after the passage of the JFK Act, only the President had authority to postpone the release of certain individual records, based on specific standards in the JFK Act. Specifically, President Trump was required to certify that 1) continued postponement was made necessary by an identifiable harm to the military defense, intelligence operations, law enforcement, or conduct of foreign relations; and 2) the identifiable harm was of such gravity that it outweighs the public interest in disclosure. 

    What happened instead?  On October 26, 2017, President Trump authorized a six (6) month “temporary” postponement for government offices and agencies to comply with final disclosure under the JFK Act.   We do not know exactly what President Trump reviewed, or did not review, in terms of actual assassination records that posed an apparent “concern” for agencies.   We do know that President Trump did not issue a record-specific certification for each record that agencies and/or the Executive Branch sought to postpone, as required by the JFK Act. 

    We also now know that a legal rationalization for “temporary postponement” was provided to President Trump on October 26, 2017.  That rationalization was in the form of a legal opinion from Curtis E. Gannon, who was then an Acting Assistant Attorney General in the Office of Legal Counsel. The rationalization proposed, in contravention of the Act, a delay of only “a few months.”  In apparent reliance on the Gannon Memo, President Trump issued an order authorizing a 6-month delay for agencies to complete their review and disclosure obligations and comply with the JFK Act.  As explained in this article, the Gannon Memo does not correctly interpret the JFK Act as written and was, from the outset, clearly designed to justify a certain outcome desired by agencies who wish to continue withholding assassination records from the American public.

    Brief Review of the “Temporary Postponement” Period

    Following the 6-month postponement discussed above, the President should have been in a position to authorize the release of all assassination records. At the very least, the President should have been in a legal position under the JFK Act to certify postponement of a handful of records and with record-specific explanations. That is not what happened. In fact, matters became far worse. On April 26, 2018, President Trump then authorized an additional three year period for agencies to “re-review” withheld assassination records and report to the Archivist on their continued requests for postponement.  In that same executive memorandum of April 2018, President Trump established a new deadline of October 26, 2021 for the Archivist and the President (now President Biden) to make final decisions on the release of assassination records.  Yes, you read that correctly – October 26, 2021.  The 6-month delay, and the multi-year delay, were completely unwarranted under the JFK Act, and mark a clear departure from law.

    It is now clear that President Trump’s decisions in October 2017 and April 2018 were based on the October 26, 2017 Gannon Memo. The Gannon Memo concluded that a delay of a “few months” was warranted based on purported concerns of the Archivist in terms of agencies not following the procedural and evidentiary requirements of the JFK Act.  The Gannon Memo did not, however, discuss the Archivist’s concerns in any detail, nor did the Gannon Memo provide the complete written report or findings of the Archivist.  Regardless, even if the 6-month delay in October 2017 was arguably warranted based on legitimate concerns of the Archivist, there is no legal justification for the President’s decision in April of 2018 for a multi-year postponement of legal obligations under the JFK Act. 

    The Gannon Memo Explored

    Gannon’s analysis is contrary to the provisions of the Act. There is no authority in Section 5 of the JFK Act for a “temporary certification” authorizing postponement.  Section 5(g)(2)(D) of the JFK Act clearly states that all assassination records were to be disclosed in full by October 26, 2017.  The President only had authority to postpone release of records past this date with a written certification “as required by this Act.” 

    The words “as required by this Act,” as cited in Section 5(g)(2)(D) of the Act, are critical to a proper legal interpretation of the JFK Act and explicitly require that Section 5(g)(2)(D) be read in context with the JFK Act as a whole.  Starkly absent from the Gannon Memo is any reference to the applicable provisions in Sections 5, 6, and 9 of the Act, which set forth the specific requirements and standards under which the President may authorize postponement.  Specifically, when the JFK Act was enacted in 1992, each Government office was promptly required to: 1) determine whether its assassination records, and particular information therein, were covered by the standards for postponement of public disclosure; and 2) specify with particularity, in an identification aid, the applicable postponement provision contained in Section 6 of the Act.  An identification aid is a standard form for identifications or findings for use with each assassination record subject to review under the JFK Act.

    In addition to the process referenced in the preceding paragraph, Section 5 of the Act then required a specific reporting action from affected agencies for any continued postponement.  Again, this was required in the early 1990’s. In 2017 and 2018, agencies had no basis to request continued postponement without providing written and unclassified reasons for postponement under the Act.  Specifically, under the agencies’ periodic review obligations, Section 5 of the JFK Act required:

    [A]n unclassified written description of the reason for such continued postponement.  Such description shall be provided to the Archivist and published in the Federal Register upon determination.” 

    In other words, without the unclassified reporting from agencies for each record sought to be postponed, the President was required to release the remainder of the protected JFK collection on October 26, 2017. The “temporary certification” of an unspecified group of records, as recommended by the Gannon Memo, can only be viewed as the Executive Branch acquiescing to last-minute appeals from agencies that did not follow the standards of the JFK Act.

    Gannon Memo Prevents a “Premature” Release Based on a
    “Strong Likelihood of Sensitivities”

    Notwithstanding the clear requirements and procedures set forth in Sections 5, 6 and 9 of the Act, the Gannon Memo, twenty-five (25) years after the creation of the JFK Act, speculated that President Trump was somehow authorized to order a “short-term” postponement necessary to avoid a “premature” release of records.  It was further supposed that said “premature” release would constitute the “identifiable harm” which would satisfy President Trump’s decision under Section 5(g)(2)(D) of the Act—although there is no clear evidence that President Trump was even aware of what specific records were being withheld and what the identifiable harm was with regard to such withheld records.  A vague presumption of a “premature” release is not a specified identifiable harm under the JFK Act. However, that appears to be the legal justification given to President Trump.

    Further, the Gannon memo presupposed a “strong likelihood” that many of the records in question would implicate the kinds of sensitivity about national security, law enforcement, and foreign affairs contemplated by the JFK Act. 

    One searches in vain for any factual or legal basis in the Gannon Memo for such a sweeping presumption. Instead, the unsupported assertion of any such “strong likelihood” that the withheld records pose an identifiable threat stands contrary to both the spirit and letter of the JFK Act.

    The Gannon Memo Creates an Escape

    Finally, and most notably, the Gannon Memo hypothesized that President Trump could satisfy Section 5(g)(2)(D) of the Act by determining that a “group” of records somehow warranted postponement, but that the President was not required to articulate record-specific justifications for further postponement of each individual record.  Again, a proper reading of Sections 5, 6 and 9 of the Act does not support the “temporary postponement” certification for an unspecified “group” of records.

    The JFK Act is void of any authority for a “short-term postponement,” or any postponement at all without the evidentiary findings required by Sections 5, 6 and 9 of the JFK Act.  Agencies had an obligation of periodic review starting with the enactment of the JFK Act in 1992, which “served to downgrade and declassify security classified information.”  By 2017, according to a tacit admission in the Gannon Memo, each record already had gone through “an extensive and individualized multi-year review process to verify that public disclosure would have been harmful in the 1990’s and would continue to be harmful through October 26, 2017.”  The Gannon Memo acknowledges that the ARRB and responsible agencies had already gone through the scrutinizing review process required by the Act, but at the same time the Gannon Memo recommended a “temporary postponement.”  Even worse, President Trump in April of 2018 authorized an additional multi-year extension for final compliance with the Act, relying on the same Gannon Memo.

    The bottom line is that, by October 26, 2017, the Executive Branch should have had at its disposal anything necessary to certify a record-specific postponement based on clear and convincing evidence and unclassified explanations filed in the Federal Register.  Yet, as acknowledged and admitted in the Gannon Memo, there are still approximately 31,000 assassination records (an indeterminable number of pages) withheld in full or in part.  The President has an obligation to either release the JFK assassination records or certify the specific reasons for continued postponement, even if agencies did not fully meet their declassification obligations under Sections 5, 6 and 9 of the JFK Act.  The evidence for postponement is available to the President based on the findings of the ARRB and a 25-year obligation for periodic review by agencies, and the American public is entitled to an unclassified certification for any records that may warrant continued withholding under the standards of the JFK Act.  President Trump, according to the Gannon Memo, had the data necessary in order to issue the proper record-specific certification under Section 5(g)(2)(D) of the JFK Act.  President Biden presumably has access to the same data and the authority to ensure compliance with the Act.

    As of the date of this article, we have not seen anything from the White House or Office of Legal Counsel in terms of resolving the purported “significant concerns” of the Archivist.  Under President Trump’s executive order of April 26, 2018, all agencies were required to report back to the Archivist by April 26, 2021 on their efforts to properly continue declassification of withheld records.  Any such reports’ existence should be a matter of public record. What is of public record, is a letter dated March 26, 2018, from the Archivist, David S. Ferriero, to then President Trump, wherein he clearly stated that, “I further recommend that you only certify further postponements through 26 October 2021, contingent upon any further recommendations for postponement being made in writing, on a document-by-document basis, by 26 April 2021 (to allow sufficient time for review by NARA and consideration by the President).” The Archivist recommended that a postponement certification by the President be contingent on a document-by-document review of a written request.  The Archivist’s statement strongly suggests that he had an interpretation of the Act that departed from the conclusions in the Gannon Memo. The Archivist’s statement is the correct interpretation of the Act.

    If the agencies did not fully or properly perform what was required under the Act, their neglect (whether intentional or not) should not be rewarded with unwarranted postponements.  This in turn places President Biden in the position of having to issue yet another executive order that does not comply with the JFK Act. 

    Crucial Difference between FOIA and JFK Act

    Unlike the Freedom of Information Act (FOIA)—and this is a key point—the burden under the JFK Act is on the government offices and agencies to meet their evidentiary burden on each assassination record before continued classification is legally warranted.  Regardless of the Gannon Memo’s interpretation of the President’s certification authority under Section 5(g)(2)(D) of the Act, the American public is entitled to a record-specific and unclassified explanation of the reasons for postponement under the JFK Act.  A broad and unsubstantiated assumption that the withheld records could contain sensitive information, is contrary to the historical and legal foundation of the JFK Act.  The operative mandate of the JFK Act is that the relevant records are presumed to be declassifiable. 

    The Gannon Memo concludes, however, that President Trump was authorized, under Section 5(g)(2)(D) of the JFK Act, to issue a temporary postponement of a “group” of records without record-specific explanations.  The rationale in the Gannon Memo is that Section 5(g)(2)(D) of the Act is “silent” as to whether the President must make a certification regarding each individual record, or whether he may make a certification applicable to a group of withheld records that raise an unspecified identifiable harm. 

    Again, the rationale in the Gannon Memo fails to account for the entirety of Sections 5, 6 and 9 of the JFK Act.  The entire purpose of the Act is to require declassification and public disclosure of all related assassination records based on specific standards.  Those standards are set forth in Section 6, and the specific statutory reason for postponement must be in unclassified form and available to the American public even if postponement is properly authorized. Section 5(g)(2)(D) of the Act cannot be interpreted in a vacuum, as was attempted in the Gannon Memo.  Doing so would unjustifiably allow the President to authorize postponements in perpetuity based on vague and opaque requests from agencies that seek to maintain secrecy, contrary to the express purpose and provisions of the Act.     

    An example of the crucial difference from FOIA, and an abuse of the JFK Act by agencies, is found in an identification aid discovered by our group of lawyers. This particular record we found listed section 5(g)(2)(D) of the JFK Act as the grounds for postponement. The evidence apparently provided was “Approval by the CIA.” Let that sink in. This is one of the most egregious things I have seen in my research of the JFK Act. What this means is that records have been withheld upon “approval by the CIA.” That is not the legal standard under the JFK Act! Only the ARRB had the legal authority to approve postponements in the 1990’s, and only the President had the authority to approve postponement in October of 2017. And if the President did authorize postponement, such a decision required unclassified written descriptions from the agencies under the JFK Act.

    Continuing Effect of the Gannon Memo

    In the broader scheme of the JFK Act, it would be completely antithetical to the entire purpose of the JFK Act to simply abandon all of the required grounds for postponement under section 6, and the detailed procedural, reporting and transparency requirements under sections 5 and 9 of the Act.  However, that is exactly what the Gannon Memo did.  Such a scheme has encouraged the various agencies to wait out the clock on the release deadlines, and then seek to postpone the release of the records on an ongoing basis for perpetuity. This is what happened at the October 26, 2017 statutory deadline, and also the April 26, 2018 and April 26, 2021 “deadlines” authorized by President Trump. Such actions are in flagrant disregard of the general purposes and the specific procedural requirements of the JFK Act, and contrary to the will of the American people as expressed by Congress when the JFK Act was enacted.

    Conclusions and Remedies

    Congress made its intent very clear in the Declarations of the JFK Act.  Specifically, Congress declared that the “legislation is necessary because Executive Order No. 12356, entitled National Security Information, has eliminated the declassification and downgrading schedules relating to classified information across government and has prevented the timely public disclosure of records relating to the assassination of President John F. Kennedy.”

    Executive Order 12356 was issued by President Ronald Reagan in 1982, in the middle of the Cold War.  Classification levels included “Top Secret” information, “Secret” information, and “Confidential” Information.  Under this Order, the President and agency heads were given classification authority under one or more of these classification levels, all on the grounds of “national security.”  A broad assertion of “national security” is not sufficient for classification under the JFK Act.  In the JFK Act, Congress clearly declared that historical executive orders have prevented the timely disclosure and declassification of assassination records, and that legislative action was required to ensure proper and timely declassification.

    Section 11 of the JFK Act is also crucial for a proper legal review of the President’s obligations under the JFK Act.  Specifically, Section 11(a) of the JFK Act states:

    When this Act requires transmission of a record to the Archivist or public disclosure, it shall take precedence over any other law (except section 6103 of the Internal Revenue Code), judicial decision construing such law, or common law doctrine that would otherwise prohibit such transmission or disclosure, with the exception of deeds governing access to or transfer or release of gifts and donations of records to the United States Government.

    In other words, when evaluating the government’s obligations for accounting to the Archivist and disclosing assassination records to the American public, Congress declared that the JFK Act is the law of the United States with only very few and extraordinary circumstances.

    The President can and should meet his legal duty to either 1) release the assassination records in full (now almost 60 years from the date of the assassination), or 2) order agencies to comply with the law and certify continued postponement only in the rarest of cases and based on record-specific findings and the “clear and convincing” evidentiary standard in the JFK Act.  Failure to do so would be an abuse of power and contrary to the intent and clear language in the JFK Act.

    I believe it is appropriate and legally warranted that President Biden rescind any prior executive orders or memoranda issued by President Trump, with respect to the JFK Act, since October 26, 2017. There is clearly a legal basis for rescission of those orders.  Regardless, President Biden should take the appropriate measures to release all assassination records without further delay; or comply with the clear and express language of the JFK Act and issue record-specific and unclassified reasons for continued postponement, based on clear and convincing evidence, as required by the JFK Act.

    Deep Fake Politics: Empire and the Criminalization of the State


    In the two previous installments of this review of Can’t Get You Out of My Head (CGYOMH) by Adam Curtis, I covered his poor handling of things like financial chicanery, monetary policy, oil markets, the JFK assassination, and “conspiracy theories” in general. To conclude this review, I am going to cover some of the ways in which Adam Curtis beguiles the audience on crucial issues such as state criminality, the dual state, geopolitics, Western imperialism, and the West’s adversaries—Russia and China specifically. Finally, I conclude with a brief summation of the CGYOMH and an exhortation for us all to take a large grain of salt with anything produced by this BBC pied piper.

    A Shallow Take on the Deep State

    Curtis has a strange way of grappling with US imperialism and the country’s secret government which emerged after World War II. In the fifth episode of CGYOMH, Curtis mentions that the CIA had been manipulating political systems and overthrowing governments around the world without the knowledge of the US public. He then brings up the illustrious Hans Morgenthau and his assessments of the American shadow government. This whole section is baffling to me. First, Curtis identifies Morgenthau as “one of the most senior members of the US State Department.” Then he says that Morgenthau “had given this hidden system of power a name, […] the dual state.” According to Curtis, Morgenthau deemed this duality necessary because of the realities of international power politics. These dark clandestine tactics needed to be hidden from the public because acknowledging them would undermine Americans’ beliefs in their democracy and in their exceptionalism—beliefs that were necessary in the Cold War.

    Curtis states that the US in the Cold War ran covert operations to overthrow 26 foreign governments in 66 attempts. Morgenthau, it is stated in CGYOMY, believed that this secrecy was creating a dangerous time bomb at the heart of America. Beginning in the 1960’s, these secrets began to be exposed by writers like former CIA officer Miles Copeland. In this section, Curtis even runs footage of a trailer from the original film adaptation of The Quiet American. The trailer is a montage featuring narration and clips from the movie which depict an American agent sowing chaos and violence “across all the Orient.” The film is certainly relevant to the discussion. That said, Curtis could have told the audience that the protagonist of the book and film is widely understood to be based on the activities of infamous CIA officer Edward Lansdale. Furthermore, Curtis could have also told the audience that Lansdale himself—acting on behalf of the CIA—was involved in the production of the film adaptation. To that end, the plot of the film was changed in such a way as to obscure the titular Quiet American’s responsibility for a terror bombing. The episode illustrates how the secret government was even manipulating the public through Hollywood—going so far as to alter those rare, informed critiques of US neocolonial imperialism in literature and film.

    Morgenthau, the Rockefellers and The University of Chicago

    But I digress. As mentioned above, Curtis’ treatment of Morgenthau and the dual state is strange. For one thing, Morgenthau did not give the dual state its name. The term comes from a German émigré named Ernst Fraenkel and his 1941 book, The Dual State: A Contribution to the Study of Dictatorship. The book described how alongside the normative state which operated lawfully, there emerged a prerogative state which operated lawlessly to serve as the guardian of the normative state.[1] Furthermore, Morgenthau is not most notable for being “one of the most senior members of the US State Department.” As far as I know, he never actually occupied a high position in the state department, though he did work there as a consultant under different US presidential administrations. Morgenthau is, however, quite famous for being the modern seminal classical realist philosopher in the field of international relations—a subdiscipline of political science. Why Curtis omits this is a mystery.

    In fact, Morgenthau’s actual academic position during those years is very relevant to Curtis’ discussion of the dual state—i.e., CGYMONH’s exploration of the lawlessness of America’s postwar secret government, because Morgenthau was a professor at the University of Chicago. Famously described as Standard Oil University by Upton Sinclair, the University of Chicago has a unique relationship to the right-wing brain trust that has informed many imperial US strategies in terms of foreign policy and political economy. Perhaps most infamously, the University served as an incubator of sorts for the neoconservative, right-wing imperialists who were heavily influenced by German émigré Leo Strauss.

    Strauss, who I will return to, himself first received Rockefeller funding thanks to the intervention of Carl Schmitt[2]—the jurist, political theorist, and prominent Nazi whose ideas informed the legal thinking of the Third Reich. In his exploration of the dual state, Curtis would have been better served looking at Carl Schmitt in order to situate the lawless US pursuit of “security.” Summarizing Schmitt, I have written elsewhere[3] that he

    …wrote famously, “Sovereign is he who decides on the exception.”[4] The state of exception “is not codified in the existing legal order.” It is “characterized as a case of extreme peril, a danger to the existence of the state.” The gravity of the state of exception is such that “it cannot be circumscribed factually and made to conform to a preformed law.”[5] Sovereignty for Schmitt is defined by the ability to decide when the state of exception exists and how it may be eliminated. Any liberal constitution can hope, at best, to mandate the party with which sovereignty rests.[6]

    In other segments of CGYOMH, Curtis mentions the critiques of Western leftists who argued that the essence of fascism had not been extinguished with the Allied victory in World War II. In the prior installment of this review, I covered Curtis’ shortcomings in terms of exploring this perspective. In his treatment of lawlessness and the dual state, Curtis compounds those errors. With Carl Schmitt and his University of Chicago descendants, there is a fairly clear German antecedent to the institutionalization of American state criminality that was established with the outbreak of the Cold War and never abandoned (i.e., an historical precursor to the lawlessness of a nominal constitutional republic). The reader may recoil at such a comparison, but the analogy is not particularly hard to grasp, psychic resistance notwithstanding. Even in terms of their respective creations, both were borne of bogus pretexts which conjured an existentially threatening Communist menace. The exceptionalist or legally unconstrained Nazi state took its mature form in the wake of the Reichstag Fire, a terror spectacle which the Nazis likely facilitated.[7] Likewise, much of the early postwar hysteria over the Soviet Union derived from erroneous Anglo-UK accusations that Stalin had grossly violated the postwar terms regarding Eastern Europe which had been negotiated at Yalta.

    All this is not to say the US is a new Nazi Germany. Only Nazi Germany was Nazi Germany, just as only the US empire is the US empire. That said, it is worth noting that in key national security documents like NSC 68, Cold War US policymakers explicitly argued for an exceptionalist approach to combating the supposedly existential threat posed by the Soviet Union.[8] I have written that such documents, in effect, served to grant

    …authority to the state to covertly conspire to violate the law. Since the US Constitution’s supremacy clause establishes that ratified treaties are “the supreme law in the land” and the US-ratified UN Charter outlaws aggression or even the threat of aggression between states, CIA covert operations are carried out in a state of exception. Given that the authority for these operations has never been suspended and the operations have been a significant structural component of the US-led world order, [I coined] the term exceptionism […] to describe the historical fact of institutionalized state criminality.[9]

    Schmitt, Strauss, and the Cold War

    To explain the duality and lawlessness of modern Western states, it is practically essential to discuss Carl Schmitt. In the German case, the Weimar Republic gave rise to a despotic dualism that quickly devoured the Republic, such as it was. In the US, the state’s lawful/lawless duality arose from the Cold War national security state which had been empowered by the supposed existential threat posed by communism. In the US case, the lawful democratic state (or public state) was never completely subsumed by authoritarian forces. This remains true, even if—as I have argued—anti-democratic forces in US society have consolidated so much wealth and power as to constitute a deep state that exercises control and/or veto power over democracy and the national security state. In my dissertation, I describe a tripartite state comprised of the public state, the security state, and a deep state.[10]

    Let us return to Leo Strauss, Morgenthau’s colleague at the University of Chicago. Strauss was an anti-Enlightenment thinker whose affinity for liberal democracy went only so far as to acknowledge that it served an important mythical function in legitimizing the hegemonic US project. One German commentator summarizes Strauss’ thinking about democracy:

    [L]iberal democracies such as the Weimar Republic are not viable in the long term, since they do not offer their citizens any religious and moral footings. The practical consequence of this philosophy is fatal. According to its tenets, the elites have the right, and even the obligation, to manipulate the truth. Just as Plato recommends, they can take refuge in “pious lies” and in selective use of the truth.[11]

    To summarize, Strauss and his mentor (of sorts) Carl Schmitt were both essentially Hobbesians. In the tradition of English thinker Thomas Hobbes, they saw the world as a dangerous and threatening place, the peril of which necessitates the creation of—and submission to—“the sovereign” or more simply, the state. The overriding imperative of the state is security, because without it, all of society is imperiled. Therefore, any measures necessary to secure the state are not just acceptable, but basically necessary. Germany infamously took Schmitt’s Hobbesian logic to a notable conclusion. Writing largely after World War II in the US, Strauss in essence advocated for state duality. He grudgingly accepted liberal democratic myths and formal institutions, while at the same time advocating for wise men like himself and his acolytes to counsel leaders, deceive instrumentally, and effect desired political outcomes in a top-down fashion. It is a mystery as to why Curtis does not mention Strauss given that the philosopher was a central figure in his interesting, but flawed, documentary series, The Power of Nightmares.

    Let us return now to CGYOMY’s treatment of Morgenthau. Curtis offers a brief summation of the realist philosopher’s thinking on the dual state that is, at best, very incomplete—and quite likely wrong. Previously and elsewhere, I wrote about Morgenthau in the same context that Curtis situates him in.

    As a 20th century analog of Thomas Hobbes, Schmitt elucidated a grim, illiberal understanding of the true nature of power within the state. Recognizing this same illiberal essence, other theorists described the “state of exception” and the securitization of politics as a slippery slope that would create authoritarianism, perhaps with pseudo-democratic trappings.[12] In the early years of the Cold War, seminal realist Hans Morgenthau would comment on these illiberal forms emerging within the American political system. He identified a change in the control of operations within the U.S. State Department. The shift was toward rule according to the dictates of “security.” Morgenthau wrote, “This shift has occurred in all modern totalitarian states and has given rise to a phenomenon which has been aptly called the ‘dual state’” In a dual state, power nominally rests with those legally holding authority, but in effect, “by virtue of their power over life and death, the agents of the secret police—coordinated to, but independent from the official makers of decision—at the very least exert an effective veto over decisions.”[13] Thus does Morgenthau describe a dynamic akin to Schmitt’s conception of sovereignty.

    To wit, Morgenthau did expound on Schmittian ideas about the sovereign and he addressed the dual state concept derived from two of the Germans discussed above: Carl Schmitt and Ernst Frankel.[14] To my knowledge, however, Morgenthau’s most noteworthy exploration of the subject was the 1955 New Republic article cited above. In this essay, he did not argue that the emergence of this dual state was positive or necessary. Rather, he bemoaned how the US State Department had been decimated by the dictates of an overweening security apparatus and he explicitly situated this dual state in the context of totalitarianism. The Nazi example would have been obviously at the forefront of Morgenthau’s mind. At the very least, Curtis should have mentioned the New Republic article and its critique, since it was written in a major US magazine. More recently, the 1955 Morgenthau essay was discussed in a scholarly article on the subject of the deep state by Swedish scholar Ola Tunander in 2009.[15]

    Curtis touches on the institutionalized lawlessness and thus the duality of the state in the US, but he fails to hash out the implications. With his blinkered treatment of Morgenthau, his omission of Schmitt and Strauss, and with his treatment of the JFK assassination, the filmmaker cannot bring himself to confront the American deep state and the cataclysmic historical episodes in which it was decisive. Discussed in greater depth in the previous installment of this review, Dallas was a coup d’état profounde—a stroke of the deep state. It is nonetheless interesting that Curtis spent any time at all covering the assassination and the deep state.[16]

    Imperial Security

    The historical limited hangout approach deployed by Curtis permeates the accounts of Western imperialism in CGYOMH. At one point, the film briefly covers the assassination of Congo’s first elected prime minister, Patrice Lumumba. To his credit, Curtis acknowledges CIA involvement in Lumumba’s death. He acknowledges that the US installed the brutal puppet Joseph Mobutu, but for some reason he fails to mention that it was Mobutu’s forces who arranged the execution of Lumumba. He states that the abrupt Belgian withdrawal plunged Congo into crisis. But he neglects to mention that this was by design—part of a plot to break away from Congo its most resource rich province of Katanga.[17] Curtis credulously reports that the US was worried that without intervention, Congo’s copper might fall into communist hands. He neglects to mention that it was the West’s refusal of help which forced Lumumba to seek Soviet aid. There is reason to believe that this was done by design, as it then gave Allen Dulles the pretext to assassinate Lumumba—an action which Eisenhower went on to authorize.

    The assassination was carried out in such a time and fashion as to indicate that people like Dulles feared a change in policy under the incoming Kennedy administration. Kennedy’s policy was much more sympathetic to Lumumba than that of Eisenhower and Dulles, but the young Congolese prime minister was killed 72 hours before Kennedy had been sworn in as president. With the facts selected and presented as they are in CGYOMH, the reader gets the impression that policies such as this were decided on the basis of myopic, but earnest, anticommunism. With Curtis, the obvious economic interests are ignored or minimized. But with Curtis, the implication is that another set of those darn bureaucrats are once again too much enthrall to another set of wrongheaded ideas.

    When one takes the longer view, this explanation falls apart. As one of the most resource-rich places in the world, Congo was brutally exploited and expropriated by Europeans for more than a century before the Cold War. During the Cold War, the plunder continued, overseen by the US-installed puppet following the assassination of Lumumba, the man who famously asserted that the resource wealth of Congo should be used for the benefit of the Congolese people. After the Cold War and up to the present day, the Congolese have been subjected to unspeakable violence on a massive scale, while the pillage of its resources has continued apace. But since Curtis filters everything through his anti-leftist lens, he cannot present cogent analysis, even when the episodes under discussion are pregnant with weighty implications.

    The Dark Art of Western Geopolitics

    In CGYOMH, Curtis looks at numerous examples of Western imperialism in places like Iraq, China, and Africa. The series would have benefitted from a discussion of geopolitics—specifically the theories of Halford Mackinder and the more contemporary policymakers and scholars who have examined Mackinder’s ideas and their applications. The Brit Mackinder looked at the world and saw that Europe, Asia, and Africa were really one massive “world island” containing most of the world’s resources and productive capacity. With Britain located on the periphery of the world island, its imperial strategists needed to assert control over key areas and destabilize or Balkanize regions to preclude any counter-hegemonic force from uniting the enormous landmass.

    The British applied this logic throughout their imperial reign. Both world wars can be seen, in part, as consequences of the applications of Mackinder’s theses. As one example, the Anglo establishment was much alarmed by Germany’s proposed Berlin-Baghdad railway. This project would have integrated Germany, Central Europe, the Balkans, and the oil-rich Middle East into a massive German-led industrial powerhouse. Interestingly, the radical historian Guido Preparata sees a Russian hand in the assassination of Franz Ferdinand and Russia was, of course, Britain’s ally at the time.[18] Prior to World War II, the Soviet Union’s existence threatened the great powers in Western Europe and the US. This no doubt informed the thinking of Anglo-US elites who helped rebuild and fuel, respectively, the German and Japanese war machines. With other factors at work—and with geopolitics not being an exact science—the anti-Soviet Anglo-American elites did not get their preferred outcome. Germany chose softer targets first before launching their ultimately ruinous campaign against the Soviet Union almost two years later.

    When the Japanese got into military conflict with the Soviets in 1939, they were soundly defeated at Nomohan. In the aftermath, Japan signed a non-aggression pact with the USSR. This would prove crucial in shaping the war’s outcome. In 1941, the Germans invaded Russia and were headed for Moscow. Since there was little threat of a Japanese invasion, the Soviets were able to send divisions from the Far East and stop the Germans just short of the capitol. The Soviet-Japanese non-aggression pact held until the last days of the war when Soviet forces swept through Manchuria, actually killing more Japanese than the atomic bombings. Though in Western historical memory, Hiroshima and Nagasaki quickly overshadowed the Soviet invasion, considerable evidence indicates that it was the crushing Japanese defeat in Manchukuo—along with the threat of an impending Soviet attack on the main islands—that actually prompted the Japanese surrender to the Americans.[19]

    As historian Alfred McCoy points out, a central strategy of the postwar US empire was to rebuild the defeated Axis powers and make them essentially US satellites. With Germany and Japan reconstructed as largely demilitarized, capitalist industrial powerhouses, the US controlled both “axial ends” of Eurasia, Mackinder’s “world island.”[20] Trade and capital flows went across the Atlantic and across the Pacific, making the US the richest empire in world history. This was by design. In retrospect, the US war in the Pacific was particularly a war for postwar hegemony. And some have argued the dual atomic bombs kept Russia out of Japan.

    The American Century

    American claims to legitimate possession over Hawaii and the Philippines—where the Japanese attacked the US—were dubious at best. They are part of a history that goes all the way back to the 1850’s. Following the imperialist Mexican-American War and the US acquisition of California, enterprising officials and businessmen looked to the Pacific to enrich the US and themselves. Starting as early as Matthew Perry’s 1853 expedition to Edo, US trade and investment in the Pacific were too lucrative to pass up. Hence, we have the absurd fact that in the Spanish-American War, ostensibly fought for Cuban independence, the first shots were fired as the US attacked the Spanish Philippines.

    Prior to US entry into World War II, Life magazine publisher Henry Luce made a case for American empire. As a mouthpiece for the Wall Street-dominated Council on Foreign Relations, Luce made the argument in his “American Century” essay, laying out the case for US hegemony over the postwar capitalist world. While much of his essay was couched in “liberal” rhetoric, in one passage he was quite candid about Asia.

    Our thinking of world trade today is on ridiculously small terms. For example, we think of Asia as being worth only a few hundred millions a year to us. Actually, in the decades to come Asia will be worth to us exactly zero—or else it will be worth to us four, five, ten billions of dollars a year. And the latter are the terms we must think in, or else confess a pitiful impotence.[21]

    Geopolitics, control of resources, markets, financial and political systems…these are the aspects of the US hegemonic reign that allow us to make sense of the activities of the intelligence agencies, the military, the business elites, and the public officials who serve these constituencies. Curtis fails to offer cogent analysis of these deep political issues. Thus, the quirky myopia of his commentary on things like covert operations, the dual state, and “humanitarian intervention.” It is worth asking whether British state television would ever sponsor an honest, penetrating documentary film that would bring the reality of our crumbling systems to a vast audience. Does the BBC exist to act in the public interest by providing the range and depth of programming needed for enlightened democratic public debate? Or does the prestige media outlet serve to entertain and manufacture consent?

    Losing the Great Game on the Eurasian Chessboard

    The most famous contemporary adherent of Mackinder’s geopolitical theories was Zbigniew Brzezinski. Co-founder of David Rockefeller’s Trilateral Commission and US National Security Advisor under Carter, Brzezinski expounded on post-Cold War geopolitics with his 1997 book, The Grand Chessboard: American Primacy and Its Geostrategic Imperatives. In it, he argued that “keep[ing] the barbarians from coming together” was a “grand imperative of imperial geostrategy.”[22] By “barbarians,” Brzezinski was referring to Russia and China. These two countries have indeed come much closer together in the intervening years, largely in response to their shared grievances under US hegemony. Termed the “rules-based liberal international order” by US officials and their media/academic courtiers, the Post-Cold War era of unipolar US dominance has by-and-large allowed the US to essentially make—and break—the “rules” of international politics according to its whims. A small number of countries have resisted US dominance with varying degrees of success. In the 21st century, three of them—Afghanistan, Iraq, and Libya—saw their governments overthrown and their societies devastated. In Eurasia, an “axis of resistance” has emerged which includes most notably China, Russia, Iran, and Syria—with Iraq in the wings as the US still refuses to honor the Iraqi parliament’s request to withdraw US military forces from the country.

    In this context, it should be noted that much of Curtis’ previous documentary series, Hyper-Normalization, devoted much screen time to denigrating two Western targets—Libya and Syria—in a multitude of dubious ways. True to form, the real villains in CGYOMH are (surprise!) Russia and China. The countries, according to Curtis, have one thing in common: they believe in nothing. Curtis states this repeatedly, though he contradicts himself, somewhat, by also stating that the Chinese only believe in money. The BBC should spring for some kind of editor to make sure that Curtis’ chauvinism is at least internally consistent, but, alas, such is not the case.

    The Soviet Union of CGYOMH appears to be the most depressing society that ever existed. Stock footage is used to depict a country of hopeless, nihilistic, victims of communism. While the post-Soviet era of Boris Yeltsin is acknowledged as a disaster, Curtis minimizes the extent to which the shock therapy privatization was a Western operation that enriched Western finance—along with that class of underworld-connected figures who became known as the oligarchs following their seizure of the Russia’s patrimony. Curtis also does not adequately explore the US interference on behalf of Boris Yeltsin in the 1996 Russian election. Portrayed in a glowingly brazen fashion on the cover of Time magazine, those US operations were of a scale far greater than even the most fanciful accusations of Russian interference in the 2016 US election.

    The true Russian villain of CGYOMH, predictably, is Vladimir Putin. To my surprise, and to the credit of Adam Curtis, he does largely dismiss Russiagate. Without spending too much time on the subject, Curtis suggests that Russiagate paranoia was symptomatic of US anomie, insecurity, and paranoia. On the one hand, it is good that even with his highly negative take on Russia, Curtis doesn’t stoop to regurgitating Russiagate claims that are thoroughly debunked—most notably by Aaron Mate in outlets like The Nation magazine and The Grayzone website. Too bad Curtis doesn’t look at the role of the dual/deep state in concocting and maintaining the hoax. CGYOMH spends a good amount of time addressing various intelligence capers. It could have been illuminating to see the Russiagate saga portrayed in a well-produced documentary film.

    Putin: That Dirty Guy!

    Instead, Curtis tells us that the dream of turning Russia into a liberal democracy went wrong and a new rapacious oligarchy came to power. At the highest levels of power, did the US ever want to see Russia become a prosperous democracy? Russia was subjected to structural economic changes that much of the rest of the world has experienced under US hegemony—privatization, austerity, massive upward transfer of wealth, and capital flight. Given the negative results of neoliberalism in the last 40+ years, why is it not assumed that those outcomes are intentionally brought about to further enrich US/Western elites and immiserate most people on purpose?

    Furthermore, with Russia, there are additional reasons to suspect that US elites deliberately wrecked and polarized Russian society. After the Gulf War, neoconservative Paul Wolfowitz said, “[W]e’ve got about 5 or 10 years to clean up those old Soviet regimes—Syria, Iran [sic], Iraq—before the next great superpower comes on to challenge us.”[23] Subsequent covert and overt US actions in the Balkans, Georgia, Libya, Ukraine, and Syria all demonstrate how the US has time and again launched military interventions in ways that threatened post-Soviet Russia’s national interests. US elites and the corporate media were major supporters of Boris Yeltsin, whose reign was an unmitigated disaster for the Russian people. These same actors now despise Vladimir Putin, a statesman who—shortcomings notwithstanding—has presided over an era in which conditions in Russia have much improved from the situation he inherited. The US media treatment of the two Russian leaders belies any claims of made about US leaders being concerned about the well-being of the Russian people in the Putin era.

    In episode six of CGYOMH, Curtis states that Putin was selected by the Russian oligarchs to rule Russia. My understanding was that he was first handpicked by Boris Yeltsin—an historical oddity given how the two men seem like polar opposites. At the time of his anointing, Curtis tells us, Putin “was an anonymous bureaucrat running the security service and a man who believed in nothing.” Having installed the nihilist Putin as president, the oligarchs thought they would continue to dominate the country. Then, as Curtis so often tells us, “something unexpected happened.” A nuclear submarine exploded and sank to the ocean floor in August of 2000. The uncertainty about the fate of the crew and the eventual news of their deaths served to outrage Russians.

    Eventually, Vladimir Putin came to Murmansk to address the public and the grieving families. Curtis tells us that Putin, “to save himself, turn[ed] that anger away from himself and towards the very people who put him in power,” i.e., the oligarchs. Putin told Russia that it was the corrupt oligarchs in Moscow who, by stealing everything, had destroyed the Russian military and Russian society. Instead of suggesting that Putin was using his office to address legitimate grievances on behalf of the vast majority of the population, Curtis tells us that Putin had instead merely “discovered a new source of power”—the anger of the people.

    Even with his new source of power, Putin continued to believe in nothing and to have no goals according to CGYOMH. A Russian journalist is quoted talking about how under Putin there is no goal, no plan, no strategy…only reactive tactics with no long-term objectives. Later, Curtis quotes another Russian journalist who claimed that what Putin had really done was to take the corruption of the oligarchs and move some of into the public sector so that Putin and his cronies in the government could get in on the corruption: “The society Putin had created was one in his own image. It too believed in nothing.” The journalist was later murdered, outrage ensued, yet things did not improve. However, oil prices soon exploded, serving to ignite a bonanza of Russian consumerism. Cue the footage of a cat wearing a tiny shark hoodie, sitting atop a Roomba, gliding over a kitchen floor, pursuing a baby duck. This, presumably, is some kind of metaphor for the directionless nihilism of Russia. Take heart, Anglo-Americans: Whatever our problems, we have yet to see such horrors in the freedom-loving West.

    Curtis goes on to check all the obligatory boxes regarding Putin and Russia. The group Pussy Riot makes an annoying appearance. Alexi Navalny, a figure with very little popular following in Russia, is credited by Curtis with “chant[ing] a phrase that redefined Russia” for a, theretofore, apolitical generation. “Party of crooks and thieves!” chanted Navalny. This, we are told, made Putin furious at the ungrateful new middle class. In response, a paranoid Putin “shapeshifted again.” He created the “Popular Front,” a Russian nationalist organization. Worse: “He summoned up a dark, frightening vison from Russia’s past,” saying that “Eurasia was the last defense against a corrupt West that was trying to take over the whole world.” Putin was articulating “a great power nationalism that challenged America’s idea of its exceptionalism.” Putin, Curtis tells us, was promoting “Russian exceptionalism!” Flash to footage of the Nighthawks, a gauche pro-Putin motorcycle gang of Russian nationalists. Curtis then asserts that the Nighthawks are promoting a “paranoid conspiracy theory” that the West, led by the US, is trying to destroy Russia.

    Adam Curtis: Reality Check I

    Where to begin with Curtis’ treatment of Russia? Putin as alleged nihilist is simply a cheap shot. The man is obviously a nationalist. This cannot be lost on Curtis, but he refuses to grant Putin even that. Instead, Putin’s moves to curb the oligarchs’ power and his efforts to resist Western geopolitical moves are all presented as crass opportunism in the service of personal aggrandizement. What should Putin and the Russians have done after Yeltsin? Curtis cannot answer this question, so he never poses it. Putin is indeed a figure that can be criticized on a number of fronts. Most significantly, his measures against the oligarchs went nowhere near far enough. The legitimacy of their vast holdings is dubious at best. If Russia were to function on a more democratic basis, one of the most popular measures would be to nationalize or otherwise redistribute what are widely perceived as the ill-gotten gains of these propertied elites. But since Curtis is first and foremost an anti-leftist, there is no discussion of such possibilities.

    Nor is there any discussion of the steps Putin did take against particular oligarchs that he deemed (with at least some justification) to be acting against the national interest. At least Curtis does not endorse Russiagate. Nor does he mention the implausible Novichok poisonings that Western security services attribute to Putin himself. These omissions are interesting in and of themselves. What of Putin’s assertion that Eurasia is the last bulwark against a US-led West bent on world domination? Curtis mocks the very notion. He does not mention that Zbigniew Brzezinski explicitly made the same argument about Eurasia over twenty years ago. Keep in mind that Brzezinski was, in my estimation, part of the more sober wing of the US imperial hivemind. He could be characterized an Establishment liberal imperialist in contrast to the unhinged neoconservative imperialists.

    Going back further in US-Russian relations, the US Joint Chiefs of Staff wanted JFK to endorse a preemptive nuclear strike on the Soviet Union to be carried out in the final months of 1963. Kennedy opposed such an unprecedented act of human barbarism. Notably, Kennedy himself was assassinated under suspicious circumstances during that same proposed window of time. Many commentators have noted how NATO has seemed to move closer and closer to Russian borders.[24] The late Robert Parry wrote often about the role of the US Embassy during the uprising in Ukraine.[25] In short, there is much historical and contemporaneous evidence that the US has sought to encroach Russia—or to at least deprive the country of any ability to impede US global hegemony. Realizing that such is the case, Russia under Putin has allied itself with its historical rival, China.

    Curtis, with China in his Sights

    At this point, it should be clear that Curtis is going to rubbish China, the most long-lived civilization in human history. Like many things in his film, Curtis does not appear to be an expert on Chinese history. On China, CGYOMH is at its most schizophrenic. Curtis acknowledges how the British devastated Chinese society with the Opium Trade and the Opium Wars. He actually soft-pedals much of this. For example, he could have mentioned that Western imperialism led to the social crises which spawned the Taiping Uprising, a conflict that killed perhaps as many as 15 million Chinese around the time of the US Civil War. Or he could have spent more time talking about the indemnities that poor China had to pay to the rich West after the Opium Wars and the so-called “Boxer Rebellion.” As I understand it, the Chinese paid over a trillion dollars’ worth of gold in today’s values as per the terms of the Boxer Protocol. This was for resisting British imperialism! The debt had only grown larger with interest before it was cancelled during World War II, when China allied with the US and British against Axis Japan. Nor is there any mention of how Japanese imperialism against China in the 1930’s was aided by the West. Such was the case up until 1940, when the US put an embargo on Japan after the Japanese invaded French Indochina. The embargo is what led to the attack on Pearl Harbor. All told, the Chinese may have lost 20 million people in the war with Japan.

    What about China after 1949? It being a communist country, Curtis is a harsh critic. Yet true to form, his critique is quirky and idiosyncratic. CGYOMH does not much mention the disastrous Great Leap Forward. Curtis discusses the Cultural Revolution, but does not explain it very well at all. Instead, it is depicted as a bizarre power play by Mao vis-à-vis his ambitious and megalomaniacal wife, Jiang Qing. The amount of time Curtis spends on Jiang Qing is completely out of proportion to her historical importance. To my understanding, she is a deeply unpopular figure in China and she comes across worse to Western students of this period of Chinese history.

    At a time when a deeper understanding of Chinese history in the West is desperately needed, Curtis does a great disservice with CGYOMH. With his cursory mentions of the Opium Wars and later of the racist Fu Manchu movies, he attempts to place a type of multicultural fig leaf over his smug imperial chauvinism. The fall of Dynastic China and the struggles of the People’s Republic of China are never properly contextualized. China was hopelessly disadvantaged against the technologically superior West in the last century of the Qing Dynasty. Due to the predations of the Western powers—and then those of the West’s Asian imitator, Japan—China was in such a horrendous state as to experience the rarest of events: a successful social revolution.

    China after 1949

    Though nominally Marxist, there was no clear way for the victorious Chinese communists to apply Marxist principles to the situation that Mao inherited. Marx saw communism as something that was a progression: from feudalism to capitalism…and eventually to communism. He explicitly stated that a communist revolution could not succeed in China or Russia, because they did not have the necessary levels of development to create the class dynamics necessary to seize the means of production. Those requisite industrialized means of production had not yet come into being outside of the Western European world, thus Marx thought that Germany was the most likely place for Communism to arise. By the 1960’s, with China having suffered some spectacular setbacks, Mao launched the Cultural Revolution. Part political struggle, part cultural crusade—it marked a time of tremendous upheaval in Chinese society. Across China, problems of the revolution were attributed to those elements of the millennia-old Chinese culture that hadn’t been discarded. As a result, the Cultural Revolution produced many tragic spectacles, including the destruction of untold numbers of great and small works of art and architecture as part of a campaign to exorcise a multitude of historical traumas.

    In this context, CGYOMH is frankly offensive in its repeated assertion that the Chinese, like the Russians, believe in nothing. Western imperialism—practiced by Europeans and then the Japanese—wrought unimaginable misery in China. It led to enormous political and cultural upheavals that most Westerners cannot fathom. In the wake of the Cultural Revolution, Deng Xiaoping took over the role as China’s helmsman. The free-market reforms introduced in this era served to slowly modernize China by integrating it into the international economy. This development also caused social dislocations and instability, with matters coming to a head of sorts during the so-called “Tiananmen massacre.”

    In the wake of the events of 1989, Chinese leaders had to grapple with the fact that the legitimizing communist ideology was insufficient. The Cultural Revolution had disoriented the Chinese people. In some sense, it robbed them of their cultural heritage. But the history, myths, legends, and spiritual practices of the past were decidedly incompatible with Marxist ideology. Furthermore, the 1989 reality of vast industrial production for the international market economy was incompatible with Marxism as well as with traditional Chinese culture wherein merchants were regarded ambivalently, at best. In response, China began to grapple anew with the past even as present conditions were changing at a dizzying pace. In the wake of that tumultuous 1989, the Chinese Communist Party commissioned a television production of the Ming Dynasty novel (set at the end of the Han Dynasty), Romance of the Three Kingdoms. Such was the dramatic disavowal of Cultural Revolution era efforts to de-Sinify China. China’s cultural inheritance was rehabilitated in the service of Chinese unity.

    Adam Curtis: Reality Check II

    For Curtis, none of this historical context is necessary. China, like Russia, is to be understood as a profoundly depressing society. Again, as Curtis would have it, China today believes in nothing while also believing only in money. Chinese organized crime is out of control. China is excessively militarized. The Chinese Communist Party is terrified of its own countrymen. The Chinese state surveilles and oppresses the citizenry. Average Chinese people have no good prospects because “the princelings” (the children of Chinese elites) are hoarding all opportunities thanks to “ultra-corruption.” This is the China presented in CGYOMH.

    Adam Curtis wants us to bear witness to the rise and fall of the Chinese official, Bo Xilai. Frankly, I cannot even figure out what CGYOMH is trying to say about Bo Xilai. I followed the story a bit when it was an international scandal in the news. I could never arrive at any salient take on the saga and Curtis does not clarify matters here. Bo did have some populist appeal. And he did seem to have some Anglophile tendencies and associations that the state would not have welcomed given Bo’s position. The whole thing seems like inside baseball—Chinese Communist-style. Perhaps this is the point: China is to be understood as an inscrutable, mysterious Oriental despotism.

    Were Curtis to be objective, he would need to inform the audience that the only significant tangible improvements in the well-being of humanity during the last 40 years are due to Chinese progress. The rest of the world—largely following US-dictated economic prescriptions and models—has stagnated or regressed with the exception of the superrich. Meanwhile in China, a billionaire class did emerge, but not without socio-economic conditions for the general population steadily improving. Unlike in the West, Chinese adults who believe that their children will be more prosperous than themselves are not delusional. China’s “militarism” seems not at all unreasonable given the US military bases encircling the country. Furthermore, China spends much less on the military that the US in both relative and absolute terms.

    For a Westerner to decry Chinese organized crime is laughable given the US governments’ partnerships with underworld figures like Meyer Lansky, “Lucky” Luciano, Santo Trafficante, Sam Giancana, the KMT, the anti-Castro Cubans, Gulbuddin Hekmatyar, the Contras, Ramon Guillen Davila, etc, etc, etc. And while there are, no doubt, privileged Chinese “princelings,” at least the Chinese can plausibly argue that their well-heeled heirs are not part of a class project to perpetually keep the bulk of the population in a state of material insecurity. In the US (and Curtis’ UK is not that much different), every aspect of life—food, housing, education, health care—is an avenue for rent-seeking and profiteering. And while aspects of the Chinese surveillance state are indeed Orwellian and alarming, it is worth keeping in mind that Western depictions of its adversaries are invariably unreliable and incomplete. Furthermore, and as Ed Snowden revealed, the US is no slouch when it comes to totalitarian surveillance. And even with the vast wealth in the US, we still lead the world in depriving our citizens of liberty in the harshest way: In both absolute and per capita terms, no country incarcerates more of its own citizens than the US.

    The Garden Paths of Adam Curtis

    In conclusion, I cannot recommend Can’t Get You Out of My Head except as a case study in sophisticated propaganda. The filmmaking talents of Adam Curtis are, as ever, impressive. However, the film’s commentary on the West is marred by a consistent failure to acknowledge the class interests that—when properly understood—illuminate so much of the unfortunate foolishness that Curtis attributes to bureaucrats and other members of the middle circles of power. The film’s deeply flawed explanations of financial/monetary matters represent a missed opportunity to explain crucial information to a badly misinformed public. Curtis’ treatments of Kerry Thornley and the JFK assassination are inexcusable, given all that we know now. His superficially revelatory discussion of the dual state represents a lost opportunity to demonstrate how the state has become our world’s most impactful and prolific lawbreaking entity. Lastly, when Curtis skewers entire swaths of humanity like Russia or the Chinese, the viewer should not lose sight of the fact that the filmmaker is on state television defaming the state’s enemies.

    Imperialism, in a word, is what Curtis can’t deal with. All the aspects of CGYOMH which I criticize in these reviews—they all pertain to Curtis and his failure to call an imperial spade a spade. I would like to assign Curtis a few books on the subject. Michael Parenti would be a good place to start. He defined imperialism as “the process whereby the dominant politico-economic interests of one nation expropriate for their own enrichment the land, labor, raw materials, and markets of another people.”[26] Compared to Curtis’ muddled ideology, Parenti’s definition can much better explain what CGYOMH bungles—namely: post-Bretton Woods dollar hegemony, the oil shocks, the Third World debt crises, neoliberalism, anti-communism, CIA covert operations, so-called “humanitarian” wars,” the postwar rise of America’s secret government, the Iraq War, and the various financial crises which always end up benefiting those “dominant politico-economic interests.” Since Curtis cannot bring himself to acknowledge the imperial elephant in the room—except obliquely or in the distant past—he cannot properly explain how the empire has devoured the republic. Without addressing the central thrust of America’s drive for global hegemony, Curtis cannot understand how this enormous concentration of wealth and power has transformed the state.

    Therefore, Curtis cannot illuminate the goings-on in the higher circles. Notably, he cannot hope to understand or explain the JFK assassination. Kennedy, for all his Cold Warrior posturing and/or pronouncements, did understand imperialism. In 1957, he gave a speech condemning French imperialism in Algeria. Said Kennedy on the Senate floor:

    [T]he most powerful single force in the world today is neither communism nor capitalism, neither the H-bomb nor the guided missile—it is man’s eternal desire to be free and independent. The great enemy of that tremendous force of freedom is called, for want of a more precise term, imperialism. […] Thus the single most important test of American foreign policy today is how we meet the challenge of imperialism, what we do to further man’s desire to be free. On this test more than any other, this Nation shall be critically judged by the uncommitted millions in Asia and Africa.[27]

    Much of the shift from colonialism to neocolonialism occurred in the 1950’s and 60’s. It was managed, often through covert operations, by the United States. Kennedy, as seen above, sparred with the Eisenhower administration (most notably, the Dulles brothers) over these policies. He supported the Third World nationalists who wanted their countries’ resources to improve the lives of their own impoverished citizens. Though Kennedy was against communism—sometimes opportunistically so—I believe the evidence today shows that he sought to end the Cold War. He pursued such a course in part to remove the threat of nuclear annihilation. But Kennedy also must have realized that the Cold War was an overriding structural constraint to any serious progressive reforms—both in the US and in the world. As long as every conflict was viewed in the Manichean, zero-sum terms of the Cold War, no US President had freedom to pursue any kind of reasonable foreign policy without encountering tremendous resistance. One can make a good argument that for his threat to the empire, Kennedy was killed. And it makes Curtis look an even bigger fool. Can he really not know that Kerry Thornley despised Kennedy over JFK’s devotion to what Lumumba stood for: a unified, independent, non-imperial Congo. President Johnson returned the US to the CFR/Acheson/Eisenhower/Dulles imperial consensus, reversing JFK’s policies in some of the world’s largest and most resource-rich countries. LBJ’s America would go on to attack the formerly colonized countries of Congo, Brazil, Vietnam, and Indonesia. Only Vietnam was able to hold on to its national sovereignty, but at an enormous cost.

    Curtis cannot grapple with JFK, just as he cannot deal squarely with those other aspects of Anglo-US imperialism. His pitiful rubbishing of the empire’s enemies seems to be his way of saying, in the midst of the collapse of US hegemony, “Look! Look at them! They have bad systems of power too—worse even!” In these tumultuous times, this is not what is needed for British or American audiences. We do not need to be fixated on what our leaders tell us is bad about our much less powerful “enemies.” These are fatal flaws in his filmography. While parts of Adam Curtis films like The Century of the Self and The Power of Nightmares are well-done, they invariably lead the viewer down garden paths in such a way as to muddle understanding and obscure responsibility. Can’t Get You Out of My Head continues in this tradition. All of this is a long-winded—yet by no means exhaustive—way of saying, again, that we need to get Adam Curtis out of our heads.

    Deep Fake Politics: The Prankster, the Prosecutor, and the Para-political


    In Part 1 of this review, I covered some of the ways in which the Adam Curtis documentary Can’t Get You Out of My Head (hereafter CGYOMH) serves to misinform the audience about the nature of power in the US-dominated global capitalist system. In particular, I chose to focus on how CGYOMH deals with high finance and the international monetary system. These are realms that Curtis tendentiously obscures and distorts. In this installment, I am going to try and unpack his muddled and incoherent takes on Kerry Thornley, the JFK assassination in its historical context, and “conspiracy theory” in general.

    JFK, the Prosecutor, and the Provocateur

    For some reason, Curtis decided to weigh in on the JFK assassination. This is an event that should be very relevant to topics and themes under discussion, namely: power, secrecy, the state, and conspiracy. Though there have been a lot of good books written about the JFK assassination, from the looks of it, Curtis apparently did not read any of them. If he had done so, there would have been many angles that he could have taken to discuss the case, even if he could not cover the assassination in a comprehensive manner. For instance, he could have talked about the impossibility of the magic bullet theory. He could have discussed the overwhelming number of witnesses in Dallas and Bethesda who reported a massive exit wound to the back of Kennedy’s head, indicating a shot or shots from the front. He could have read David Talbot’s Brothers and then discussed how RFK came to believe that his brother had been killed as the result of a right-wing plot involving elements of the CIA, the Cuban exile community, and organized crime. The audience might have also appreciated learning about how RFK was assassinated before he could attain the presidency and reinvestigate Dallas—something he explicitly said he would do. Or Curtis could have focused on how, beginning in the immediate aftermath of Oswald’s assassination, Establishment figures like Dean Acheson, Eugene Rostow, and Joseph Alsop began lobbying LBJ to create a “blue ribbon” commission that would arrive at a predetermined no-conspiracy conclusion. Additionally, Curtis could have revealed that as part of this exercise, LBJ used the specter of nuclear Armageddon to pressure Chief Justice Earl Warren and Senator Richard Russell into joining the commission.

    Curtis didn’t do any of the above. Not even close.

    For whatever reason, Curtis focuses on the figure of Kerry Thornley. In and of itself, this is not the worst choice. Thornley’s bizarre and implausible actions point very strongly to the conspiracy behind Dallas. But alas, it seems that since the grim implications of a coup d’état in Dallas would so dramatically falsify Curtis’ quizzically iconoclastic worldview, the director instead must offer a quirky and incoherent take on Kerry Thornley and his nemesis Jim Garrison. Regarding the Adam Curtis worldview that precludes him dealing with Dallas forthrightly, it is a difficult thing to pin down. Given that he has produced documentary films, totaling dozens and dozens of hours of runtime, it is noteworthy that one cannot get a clear grasp of what Curtis’ worldview actually is. I have to conclude that this is intentional on the part of the filmmaker, and that it is pretty dubious in and of itself. The easiest thing to say about his politics, which I mentioned in Part 1 of this review, is that he is anti-left. His anti-leftism takes an odd form, as he does not extol any obviously right-wing ideas. Instead, he often seems suspicious of power—especially technocratic power—but he seems even more suspicious of those who are suspicious of power. His detached, faux-anarchist analysis—for reasons I’ll not fully articulate—brings to my mind another British persona, the famed Bilbo Baggins. While I have a fondness for Tolkien’s The Hobbit, I would not look for someone like Bilbo Baggins to illuminate the dark pinnacle of capitalist imperium.

    So, what does Thornley do for Curtis? He largely serves to allow Curtis to be dismissive of “conspiracy theories,” even as he is superficially ambivalent about actual conspiracies elsewhere in the film. The conspiracies he does acknowledge are attributed to conspirators of low to middling status or non-Westerners. The ultimately sad or pathetic conspirators include Michael X, Jiang Qing, the cops who entrapped some Black Panthers, and European Red Guards. Even when Curtis acknowledges CIA plots to overthrow governments in places like Congo, Syria, and Iraq, they are not explained as being part and parcel of the geopolitical strategy of US imperialism. Rather, Curtis seems to imply that these disastrous interventions are the product of bureaucrats who are in some way misguided. Though there are innumerable instances where such covert operations (i.e. conspiracies) can be easily traced back to a materialist motive, Curtis doesn’t seem to want to state this clearly or to hash out the implications. Even when he does acknowledge the postcolonial exploitation of the Third World, it seems to be some sort of piecemeal phenomena arising through random policy choices.

    Thornley’s tale is curated so that he can play the role Curtis has in mind for him. It is deftly rendered and dispersed in random intervals throughout the eight-hour runtime of CGYOMH. The Kerry Thornley arc in CGYOMYH begins with Curtis telling us how Thornley and his friend Greg Hill went to a bowling alley where they disagreed about whether the universe was orderly or chaotic. They eventually came to the conclusion that the world was chaotic, but that individuals could use their minds to create some semblance of order. But then something strange happened. Thornley joined the Marines, where he met a young defiant man named Lee Oswald. He decided he would write a novel about Oswald. While Thornley was writing this novel, Oswald defected to the Soviet Union. As a right-wing Ayn Rand devotee, Thornley detested Kennedy. He did not mourn when JFK died. But the fact that the figure he cast in his novel was the president’s alleged assassin was, according to Thornley, “very weird.”

    A little over two years before the assassination, Kerry Thornley moved to New Orleans with Greg Hill. They had begun to spin a spoof religion called Discordianism. Curtis states that around this time, Thornley got his Oswald novel published under the title, The Idle Warriors. This is an error; the novel did not get published until 1991—in the wake of Oliver Stone’s JFK. As Curtis would have it, Thornley ran into trouble because of the novel and the fact that—like Oswald before the assassination—Thornley was living in New Orleans in 1967. Thusly, Thornley “came to the notice of the man who was going to be the main creator of the JFK conspiracy theory…Jim Garrison.”

    Curtis does not present Garrison favorably. He states that:

    Jim Garrison believed that the modern democratic system in America was just a façade. That behind it was another secret system of power that really controlled the country, but you could never discover it through normal means because it was so deeply hidden.

    Curtis reveals that Garrison wrote a memo entitled “Time and Propinquity” for his staff, in which he tried to explain how they might grapple with this secret government. Meaning and logic are always hidden and so they should instead look for patterns—strange coincidences and links that are apparently meaningless but in actuality evidence of the hidden system of power. Curtis asserts that Garrison’s theory would be a big impact on how many people would come to understand the world:

    In a dark world of hidden power, you couldn’t expect everything to make sense. [I]t was pointless to try and understand the meaning of why something happened, because that would always be hidden from you. What you looked for were the patterns. And when Garrison read Kerry Thornley’s novel, he saw a pattern. Not only had Thornley been in the Marines with Oswald and written a novel about him, but he had come to live in the same city that Oswald had lived in before the assassination. And in 1967, Garrison accused Thornley of being part of the conspiracy. Thornley was furious; he knew that Garrison was wrong, but he also hated the very idea of conspiracy theories.

    Thornley, Curtis tells us, believed that people in power used conspiracy theories to control people by making them believe that the world was run by hidden forces. This served to make individuals feel “weak and powerless.” Curtis does not bother to point out that Thornley is essentially positing a conspiracy theory to explain conspiracy theories. Thornley claimed that he wanted to free people from the conspiratorial thinking that held them back. He wanted to break people out of their “authoritarian conditioning.”

    II

    As he began to take on the CIA in the mid-1960’s, Garrison was necessarily flying blind to a certain degree. The massive clandestine intelligence community was something novel in the American experience. A few exposés of limited scope had been published in the 1960’s, most notably The Invisible Government by David Wise and Thomas Ross.[1] Ramparts magazine also published some important articles on the CIA in the 1960’s but, to put it mildly, Ramparts was an outlier in the US media landscape.

    It wasn’t until the 1970’s that a fuller picture of the clandestine state began to emerge, thanks to the work of people like Daniel Ellsberg, Fletcher Prouty, Phil Agee, Victor Marchetti, Alfred McCoy, and Peter Scott. In terms of Garrison and the “Time and Propinquity” ideas that Curtis ridicules, the work of Scott is quite relevant. Writing about obscured intrigues related to the Vietnam War, covert operations in the Third World, mafia-intelligence nexuses, and the assassinations of the 1960’s, Scott came to realize that the existing methods of journalists, historians, and social scientists were insufficient in terms of being able to elucidate realities shaped by powerful clandestine actors. He coined the term parapolitics to describe “a system or practice of politics in which accountability is consciously diminished.”[2]

    In the course of Garrison’s investigation, he wrote many memos to his staff. Only a relatively tiny number of them were related to “Time and Propinquity.” The overwhelming vast majority of his inquiry was done through on-the-ground investigation (e.g. going to the Dallas area and trying to interview suspects like Cuban exile Sergio Arcacha Smith). Curtis ignores that fact. Using a technique that originated with the late rightwing pundit Tom Bethell—who betrayed the DA—Curtis ridicules Garrison for these ideas. (Click here for details)

    Garrison was merely trying to offer a strategy that might allow his office to do something heretofore not encountered—the successful prosecution of state actors whose crimes are supported by huge budgets, secrecy, and a license to covertly break laws in the name of national security. In fact, to bear this out, Garrison once wrote a memorandum to House Select Committee attorney Jon Blackmer about solving the JFK case. He said you could not solve this crime in the usual manner that felony investigations use (i.e. fingerprints, written records used as alibis, etc.). That would not work, because the JFK assassination was designed as a clandestine action.

    What should be done if—as Garrison ascertained—politico-economic elites, clandestine state actors and insiders can veto the will of the public by assassinating a democratically elected head of state? What if, additionally, it becomes clear that the national media and academia are under the hegemonic sway of the same elite of power, and thus cannot act institutionally as the democratic checks described in liberal political theory? Ultimately, Curtis can offer no alternative to parapolitical research or Garrison’s foray into the realm.

    In the face of this, Curtis instead blithely asserts:

    Thornley was right that most of what Garrison alleged was complete fantasy. Despite all the patterns, he could produce no evidence of a hidden conspiracy.

    If the reader can believe it, this is Curtis’ last word on Garrison. He does not mention that Garrison had convinced the jury at the Clay Shaw trial that the assassination was the result of a conspiracy. That was accomplished through one exhibit and two key witnesses. The witnesses were Dr. John Nichols for the prosecution and the second was the devastating cross examination of defense witness and Kennedy pathologist Dr. Pierre Finck. The exhibit was the Zapruder film, which Nichols’ used to convincingly demonstrate a shot came from the front. This showed, at the least, that Lee Oswald was not the only assassin firing at Kennedy, which would mean JFK was killed by a conspiracy. So it’s convenient for Curtis to leave it out.

    Garrison also discovered that Oswald had been in New Orleans as an ostensibly pro-Castro activist, but had been working out of the office of Guy Banister—a hard-right, ex-FBI man who ran the Anti-Communist League of the Caribbean, was a member of the fascist “Minutemen” organization, and had been involved in anti-Castro CIA operations like the Bay of Pigs and Operation Mongoose. Given that Oswald’s New Orleans activities only served to discredit the Fair Play for Cuba Committee, the obvious inference would be that Oswald was a pawn in some kind of counterintelligence operation. The Zapruder film was so definitive that when it was finally shown on network television in the 1970’s, public support for the Warren Commission fell to all-time lows.[3]

    Years later it was revealed that Clay Shaw lied on the stand numerous times. (Click here for details) He was also getting considerable support from the CIA during the trial. And, just as Garrison alleged, Shaw had indeed perjured himself when he stated that he had had no relationship to the CIA. Additionally, there is no excuse for Curtis’ failure to mention that the last official word on the JFK case—the HSCA investigation—concluded that the assassination was the result of a “probable conspiracy.” He then also fails to disclose to the audience that the chief counsel of the HSCA eventually signed on to a petition which stated that the culprits were elements of the US national security state.[4]

    Curtis and Conspiracy

    Upon returning to Thornley and Discordianism, CGYOMH details how the group decided to use Playboy magazine to launch “Operation Mindfuck.” They kicked off the operation by submitting a fake letter positing that all the political assassinations in the US were the work of “the [Bavarian] Illuminati.” The Discordians began to spread this notion throughout the pop culture landscape. Thornley, Curtis states, was trying to break the spell of conspiracy theories by exposing the absurdity that a secret society in Bavaria could be covertly ruling the word. Here again, Curtis does not bother to point out that the Discordians were conspiring to discredit conspiracy theorizing. Any explanation of Operation Mindfuck is by definition a conspiracy theory. To acknowledge this truism would entail something that Curtis does not want to admit or explain: that any conspiracy theory—like any no-conspiracy theory—should be judged on its respective merits.

    One of many dispiriting aspects of CGYOMH is that Thornley and Operation Mindfuck are actually interesting subjects whose reexamination could offer fresh insights. The work of the illustrious and iconoclastic Florida State professor Lance DeHaven-Smith is instructive in this regard. By the end of the year 2000, DeHaven-Smith had already enjoyed an accomplished career as a scholar of public administration. However, as the top authority on Florida state politics, he was shocked when George W. Bush’s team was able to steal the 2000 election, committing multiple felonies in the process.[5] This experience radicalized the professor and led him to coin the term state crimes against democracy (SCADs). He defined SCADs as “concerted actions or inactions by government insiders intended to manipulate democratic processes and undermine popular sovereignty.”[6]

    Upon being forced to reassess historical events that he had lived through, DeHaven-Smith came to be alarmed by the strong social and academic norms which served to discourage and stigmatize reasonable suspicions of conspiratorial state criminality. In 2013, he published Conspiracy Theory in America. There he detailed the ways in which powerful actors and institutions have aided and abetted SCADs by stigmatizing those who posit conspiratorial explanations of politically significant events:

    Most Americans will be shocked to learn that the conspiracy-theory label was popularized as a pejorative term by the Central Intelligence Agency (CIA) in a propaganda program initiated in 1967. This program was directed at criticisms of the Warren Commission’s report. The propaganda campaign called on media corporations and journalists to criticize “conspiracy theorists” and raise questions about their motives and judgements. The CIA told its contacts that “parts of the conspiracy talk appear to be deliberately generated by Communist propagandists.” In the shadows of McCarthyism and the Cold War, this warning about communist influence was delivered simultaneously to hundreds of well-positioned members of the press in a global CIA propaganda network, infusing the conspiracy theory label with powerfully negative associations.[7]

    DeHaven-Smith refers to this episode as “The CIA’s Conspiracy-Theory Conspiracy.”[8] Given that, as referenced above, the CIA was conspiring in 1967 to use its propaganda assets to manipulate public discourse around conspiracy concepts in the JFK assassination and given that 1968 would see another pair of cataclysmic assassinations of progressive leaders—MLK and RFK—does not the Discordians’ Operation Mindfuck plot dovetail perfectly with the Agency’s goal of stigmatizing conspiracy theorizing around suspicious political events? As we will see, this becomes all the more apparent when one looks at the overwhelming amount of evidence that Kerry Thornley was an intelligence asset involved in creating the legend that made Oswald a suitable designated culprit in the JFK assassination.

     

    III

    At the end of the first episode of CGYOMH, Curtis dismisses the idea of conspiracy in the JFK assassination. Thereby implicitly endorsing the Warren Commission’s conclusion that the president was assassinated for no discernable reason by a “lone nut”; who was subsequently assassinated by a concerned local pimp in a room full of policemen. Curtis invokes the tired JFK trope which explicitly or implicitly posits that since there are so many different wacky JFK conspiracy theories—featuring the KGB, the KKK, J. Edgar Hoover, the mafia, Castro, Nixon, the CIA—none of them can be valid. For those of us who feel that the truth of the JFK assassination is pretty obvious, Curtis is another example of a person who would accept, say, the magic bullet theory, rather than suffer the cognitive dissonance of acknowledging despotic political realities in the nominally “liberal democratic” West.

    Postwar Deep Politics

    Curtis cannot truly grapple with deep politics: “all those political practices and arrangements, deliberate or not, which are usually repressed rather than acknowledged.”[9] This does not set him apart from mainstream historians and political commentators in the West. What is noteworthy about Curtis is that he produces so much work that delves into these areas, while always coming up with tendentious, limited-hangout summations, analysis, and conclusions. If it wasn’t obvious, this is why I chose to title this review “Deep Fake Politics.”

    His intervention into Dallas has already been discussed above. Additionally, he looks into other important episodes as though he is going to reveal something important, while invariably coming up with a narrative that is less than we already know. Or less than we should know were we not so propagandized and beguiled by our Western sense-making institutions. For example, Curtis states that some radicals in the West believed that the Nazi system was hiding behind the liberal façade. This is an important and fascinating issue. To what extent did key figures and institutions from the defeated Axis powers continue to exist postwar, in some form or another? We know that the US made use of notorious Nazis like Klaus Barbie, Reinhardt Gehlen, and Otto Skorzeny—as well as Nazi scientists like Wernher von Braun.

    Furthermore, the German economic elites of the Nazi era were also allowed to retain power and wealth in the postwar system. The Nazis were brought to power by an elite group of German industrialists, whose cartel system gave them control over the commanding heights of the German economy. After the war, James Stewart Martin was the director of the Division for Investigation of Cartels and External Assets in American Military Government. In that position, he was charged with breaking up the Nazi cartel system and investigating its ties to Wall Street. His efforts were undermined by his superior officer, a man who had been an investment banker before the war. Stewart chronicled these events in a book published in 1950, concluding that “we had not been stopped in Germany by German business. We had been stopped in Germany by American business.”[10] Curtis chooses not to explore this issue deeply, leaving the impression that those who detect any semblance of Nazism under postwar US hegemony are fringe radicals or idealists, certainly not sober observers offering a historically grounded assessment. In postwar Japan, the situation was also similar. The US made use of sinister war criminals like Yoshio Kodama and largely preserved the Japanese elites who presided over the massive zaibatsu corporate conglomerates. I recall that in one interview, the illustrious Japan expert Chalmers Johnson made a quip about the Sony Walkman in the 1980’s, “From the people who brought you Pearl Harbor.”

    The Pivotal 1970’s

    In episode three, Curtis looks at Watergate and the tumultuous, poorly understood 1970’s. He describes Nixon as a paranoid man, obsessed with perceived enemies. He describes Nixon as having come to power thanks to the “silent majority” of Americans who felt isolated and alone. In other words, there is no mention of two crucial political crimes: the assassination of Senator Robert Kennedy and the 1968 “October counter-surprise,” in which candidate Nixon sabotaged peace talks in Paris that could have ended the war before the 1968 election.     Robert Kennedy was planning to reinvestigate his brother’s assassination, believing—as did Jim Garrison—that JFK was murdered as the result of a conspiracy involving elements of the national security state, the Mafia, and Cuban exiles. This merits no mention from Curtis. Instead, Nixon and other Americans of the time were just feeling less connected and more paranoid, because of Vietnam. We are told about Nixon’s paranoia about the liberal establishment and his enemies list. His taping system recorded his paranoia. The president became obsessed with trying to destroy his “imaginary enemies.” To that end, Richard Nixon—one “of the most powerful people in the world”—kicked off a White House conspiracy that involved using ex-intelligence agents to crush his opponents. The Plumbers’ activities would expose Nixon’s criminality in the Watergate scandal. Says Curtis, “[I]n its wake, all kinds of other revelations came out—of dark secrets in the political world that had been kept hidden from the people…For twenty years, the CIA had been planning assassinations and overthrowing leaders of foreign governments all around the world using poisons and specially made secret weapons.”

    IV

    To say that this is an elision is not nearly strong enough. It makes one ask: Adam, what did you read in preparation?

     Nixon’s enemies were hardly imaginary. They were not confined to any “liberal establishment.” Nixon was being spied on by a cabal of right-wing Pentagon officials who were eventually caught red-handed. This is called the Moorer/Radford affair. (Click here for details) Further, as the late Robert Parry demonstrated, the origins of the Plumbers Unit was not over the release of the Pentagon Papers, as previously imagined. It was over the Lyndon Johnson/Walt Rostow memo exposing the 1968 October Surprise by Nixon and Claire Chennault. (Click here for details) It is really hard to fathom how Curtis missed these key historical points.

    Perhaps more significantly, Nixon could not get the CIA to cooperate with him in a number of key areas, including the president’s attempts to obtain all the CIA files which might explain the JFK assassination and the Bay of Pigs operation. (Click here for details)

    Nixon eventually fired Dick Helms, the director of the CIA, and ordered his successor, the outsider James Schlesinger, to compile all information about CIA crimes. He took these actions, in part, because he believed that the CIA was somehow involved in the Watergate scandal. There were good reasons for his suspicions. Two key Watergate figures—James McCord and E. Howard Hunt—were “former” CIA officers, were politically to Nixon’s right, and were so operationally incompetent that many suspect that they intentionally bungled their crimes as part of an operation to damage or gain control over the president.[11]

    The report of the CIA’s violations came to be known the “Family Jewels” and some of its contents were leaked to the press. These revelations, plus Watergate, eventually gave rise to two congressional investigations of the intelligence community. It is important to note that these leaks about Nixon, and about Nixon’s adversaries like the CIA, were part of what can be described as an Establishment civil war. To say that Nixon was merely paranoid about his liberal enemies is to greatly distort this history. Furthermore, such an explanation cannot explain how the ouster of Nixon led to the US lurching far to the right politically. Both major parties became more conservative. The liberalism of the Kennedys was excised from the political power structure. The Republicans became a Reaganite party and the Democrats adopted positions that had previously been associated with Rockefeller Republicanism, cultural politics notwithstanding.[12]

    Thornley: Conspiracist or Conspirator?

    Years after launching Operation Mindfuck, Thornley says he saw E. Howard Hunt’s photo after his Watergate arrest. He now recognized Hunt from his New Orleans days, when he also knew Oswald (although he was very reluctant to admit this, and one could argue he did not).

    And then, strangely, Thornley also recalled how he had known Guy Bannister and Clay Shaw, suspects in Jim Garrison’s investigation. Previously, Thornley had disregarded these matters. Suddenly, says Thornley, “I could not explain all these weird coincidences.” While the Operation Mindfuck hoax/operation promulgated an Illuminati meta-conspiracy theory, these bogus theories were getting mixed up with real world intrigues like CIA mind control and other scandals. Says Curtis, “The line between the reality of political corruption and a dream world of conspiracy theories started to get blurred in America.” Kerry Thornley, Curtis suggests, became swept up in this paranoid thinking. Thornley came to believe that the CIA had somehow manipulated him into setting up Operation Mindfuck, but he didn’t know how. Says Curtis, “Thornley had retreated into a dream world of conspiracy.”

    V

    For viewers not steeped in the JFK assassination, Curtis’ depiction of Thornley would not raise much suspicion. He would seem like a wacky and unlucky character, who wound up facing some troubles because of a bizarre set of coincidences. However, Curtis leaves out a tremendous amount of material that complicates matters considerably. Let us fill in what Adam Curtis could not find out about Kerry Thornley.

    For one thing, Thornley was an extreme right-winger and Kennedy hater. He was a devotee of Ayn Rand,[13] but his politics were even more reactionary than mere libertarianism. He had been a strong supporter of the Belgian scheme to recolonize Congo by creating a breakaway state in the resource rich province of Katanga. This was a vicious plan that was ultimately thwarted by President Kennedy after the assassination of Patrice Lumumba and the death—likely the assassination—of UN Secretary General Dag Hammarskjold. Thornley cited Katanga as one of the main reasons he hated Kennedy. When Kennedy was killed, Kerry couldn’t help himself: he began singing while at his restaurant job. He later urinated on Kennedy’s grave. In a 1992 interview for the television program A Current Affair, Thornley stated about Kennedy, “I would have stood there with a rifle and pulled the trigger if I would have had the chance.” Summing up Thornley’s politics, Jim DiEugenio writes, “What kind of person would celebrate the murder of Kennedy and the victory of colonial forces seeking to exploit both the native population and vast mineral wealth of Congo? […] I would call those kinds of people fascists.”[14]

    There are more key facts and events that Curtis omits from his tale. The Thornley and Hill move to New Orleans in February 1961 has never been adequately explained. It strains credulity to think that it was in response to a cop accusing the pair of loitering. New Orleans at that time was quite a place for a budding fascist to be. Right at the time of their arrival, preparations for the Bay of Pigs invasion were ramping up. Ultra-rightists and Garrison suspects like David Ferrie and Guy Bannister were involved in these operations, conducted at locales such as the Belle Chase naval air station and Banister’s 544 Camp Street office.[15] Upon arriving in New Orleans, Thornley began associating with these hard-right, CIA connected circles. When Garrison’s office questioned Kerry Thornley in 1968, he denied that he knew Guy Banister, David Ferrie, or Clay Shaw. However, in the mid-1970’s, when the HSCA investigation was about to begin, Thornley admitted that, in fact, he had known all of these characters. Furthermore, when his book on Oswald, The Idle Warriors, finally got published in 1991, Thornley admitted in the book’s introduction that he showed the manuscript to Guy Banister back in 1961.[16]

    Just prior to Thornley’s arrival in New Orleans, Banister was linked to a shocking incident. The Friends of Democratic Cuba (FDC) was a CIA/FBI shell company. Guy Bannister was one of its incorporators, and two other FDC members at times operated out of Guy Bannister’s 544 Camp Street office. In late January 1961, two men walked into a Ford Truck dealership claiming to be members of the FDC. They were looking to buy ten Ford Econoline vans. The man who did the negotiating was Joseph Moore, but he wanted his colleague to co-sign. The man co-signed simply as “Oswald” and told the dealer that his name was Lee.[17]

    It is hard to take seriously any non-conspiratorial explanation of these events. Thornley decided to write a novel based on a not-especially-interesting marine who defected to the Soviet Union. While this hapless Marxist was in Russia, some CIA assets were impersonating this wayward young marine while conducting FDC/agency business. Then Thornley whimsically decided to show up in New Orleans, where he happens to meet Guy Banister—one of the figures involved in creating the FDC. So, he shows Banister the novel he has written about Oswald, the same guy that Bannister’s FDC associates are impersonating. And apparently Adam Curtis doesn’t bat an eyelash.

    In testimony before the New Orleans grand jury, Thornley denied that he had associated with Oswald during Oswald’s time in New Orleans. This was implausible given that they had known each other in the Marines, that Thornley had written a novel about Oswald, and that the two men knew many of the same people and frequented the same places. In fact, Garrison had at least eight witnesses who had seen Thornley and Oswald together during that summer. Two of these witnesses stated that Thornley had told them that Oswald was, in fact, not a communist. Garrison had a witness who said that she, “her husband, and a number of people who live in that neighborhood saw Thornley at the Oswald residence a number of times—in fact they saw him there so much they did not know which was the husband, Oswald or Thornley.”[18]

    In that 1963 summer in New Orleans, Oswald was famously arrested while passing out Fair Play for Cuba Committee (FPCC) leaflets. The New Orleans Secret Service investigated this incident and eventually looked into the company that printed the FPCC leaflets.[19] In Never Again, researcher Harold Weisberg wrote that,

    [When] the Secret Service was on the verge of learning, as I later learned, that it was not Oswald who picked up those handbills, the New Orleans FBI at once contacted the FBI HQ and immediately the Secret Service was ordered to desist. For all practical purposes, that ended the Secret Service probe—the moment it was about to explode the myth of the “loner” who had an associate who picked up a print job for him.[20]

    As an investigator for Garrison, Weisberg interviewed two of those print shop employees. They identified Thornley, not Oswald, as the person who picked up the FPCC flyers. When Weisberg told Garrison investigator Lou Ivon about this, Bill Boxley—a CIA infiltrator in Garrison’s office—tried to distort and downplay the significance of the event. However, Weisberg had surreptitiously recorded one of those interviews and the recording served to quiet Boxley. Unfortunately, the tape—like many of Garrison’s files—soon disappeared.[21]

    Thornley also denied to the Garrison team that he knew Carlos Bringuier and Ed Butler. Bringuier was part of the CIA-backed Directorio Revolucionario Estudantil (DRE) and Butler ran Alton Ochsner’s CIA-backed Information Council of the Americas (INCA). Thornley did eventually admit that he knew both of these men.[22] Butler and Bringuier were both involved with Oswald in an infamous radio debate. This followed Oswald’s arrest after a confrontation with Bringuier, during his strange FPCC leafleting spectacle. In the radio debate, it was revealed that Oswald was a Marxist who had previously defected to the Soviet Union. This served to discredit the FPCC by associating it with communism and the Soviet Union. As many people have noted, this seems to have been the objective that Oswald believed he was furthering—some sort of psychological operation for propaganda purposes. If there were any doubt about this, it should be dispelled by the fact that the flyers were stamped with Guy Banister’s 544 Camp Street address.

    VI

    In summary, Thornley, Bringuier, and Butler were all instrumental in creating the evolving Oswald legend. Thornley first did so by depicting Oswald in The Idle Warriors as a communist malcontent in the Marines. Then he furthered Oswald’s legendary persona through his and his associates’ activities in New Orleans. If Weisberg is correct, this may have included assisting Oswald in his FPCC leafleting spectacle. That playlet got Oswald arrested and led to the infamous radio interview with Butler and Bringuier. On the day of the assassination, the CIA—via Bringuier’s DRE—quickly formulated the first JFK conspiracy theory: that Oswald was in some way an agent of Castro’s Cuba.

    Less than 24 hours after the assassination, conservative Senator Thomas Dodd had Butler brought to Washington, so the propagandist could offer congressional testimony about Oswald. Thornley, who referred to the assassination as “good news,” was interviewed by the Secret Service 36 hours after the assassination and by the FBI a day later. Just days after the assassination, Thornley abruptly left New Orleans with ten days of rent left on his apartment. He went to Arlington, Virginia and was eventually called to testify to the Warren Commission. Conforming to the new cover story of Oswald as a discontented lone nut, Thornley’s testimony offered lots of psychology analysis that would never have been admissible in court. However, this sort of testimony suited the Warren Commission perfectly well.[23]

    Years after the Warren Report was issued, Thornley—as mentioned above—went on to perjure himself before a grand jury in New Orleans about not knowing or meeting Oswald during that brief but spectacular summer in New Orleans. At one point, Thornley agreed to meet with a Garrison investigator, but only if the meeting were held at NASA. Given Thornley’s low status in conventional terms, it is hard to understand how he could command entry to such a location. NASA also happened to be the place where several of Oswald’s former co-workers at the CIA-connected Reily Coffee Company would later find employment. The task of locating Thornley in the first place was also a challenge for Garrison’s staff. Eventually, it was discovered that he was in Florida. Thornley, who since leaving the military had only held jobs as a waiter and a doorman, had two homes—one in Tampa and one in Miami.[24]

    Following the Garrison investigation, Thornley faded from notoriety. He only reemerged in the mid-1970’s at around the time that the HSCA began reinvestigating the JFK assassination. At this point, Kerry reappeared as some kind of iconoclastic, hippie burnout—albeit one with ultra-rightist politics. Suddenly, Thornley did a complete reversal on the question of conspiracy. He admitted knowing many of the targets of Garrison’s investigation. He even sent Garrison a long manuscript which detailed his strange version of a plot behind Dallas.[25] This document is but one of the elaborate disinformation ruses that Garrison received at different times. Two other infamous and more elaborate examples were the manuscripts Nomenclature of Assassination Cabal and Farewell America.

    Though Thornley at this point admitted knowing Ferrie and Bannister, and even E. Howard Hunt, he claimed that these were not the real conspirators. Absurdly, Thornley was then asserting that the actual plotters were characters known as Slim, Clint, Brother-in-law, and Gary Kirstein.[26] Kerry said he later figured out that two of these men were Hunt and Minuteman Jerry Milton Brooks under pseudonyms. This is but one example of how the HSCA, like the Garrison investigation, was beset by disinformation agents. Besides Thornley, figures like Marita Lorenz and Claire Booth Luce led HSCA investigators on many pointless diversions.[27] John Newman has recently argued that Antonio Veciana was doing something similar to HSCA investigator Gaeton Fonzi by exaggerating the importance of David Atlee Phillips and by distracting from the relationship between army intelligence and Veciana’s Alpha 66 unit.[28]

    Conclusion

    Thornley’s activities, and his perjury about them, are completely bizarre and inexplicable, unless one posits that he is a low-level intelligence operative. When one looks at these episodes with that possibility in mind, all the otherwise ridiculous episodes are quite logical. The same holds true for Thornley’s famous friend, Lee Harvey Oswald. In Oswald’s case, his Marine discharge, defection, repatriation, Dallas associations, New Orleans escapades, Mexico adventures, and behavior during his last days are all impossibly weird—unless and until the intelligence angle is examined. Unfortunately, this is how we must approach facts and evidence in para-political contexts. The Warren Commission’s official story, and Thornley’s key role in creating that transparent myth—he is quoted three times in the Warren Report to characterize Oswald—simply collapses under this kind of analysis.

     The JFK assassination should be recognized as a state crime against democracy in the context of America’s deep political system. Such an understanding points to the existence of a despotic, exceptionalist state that can exercise veto power over democracy. Unsurprisingly, this is not a perspective that Curtis and the BBC would look to promote. Predictably, CGYOMH opts to ridicule and dismiss Garrison and critics of the Establishment’s JFK assassination theory[29]—the theory of the lone nut who gets killed by another lone nut, i.e. the dual nut theory.

    All of this is not to say that Garrison was beyond reproach. He should not have been so trusting with the volunteers he allowed to work on the case. He should have indicted Ferrie sooner, lest his main suspect succumb to a deadly brain aneurysm whilst sitting on the couch looking at two typed, unsigned suicide letters. Furthermore, given all the things that have come out about Kerry Thornley, Garrison arguably should have sought to prosecute him rather than Clay Shaw. One reason to argue that Garrison should have gone after Thornley for conspiracy to commit murder comes from Thornley himself. Said Kerry Thornley, “Garrison, you should have gone after me for conspiracy to commit murder.”[30] Admittedly, Thornley was positing a contrived hoax, but even this JFK disinformation is of a piece with his prior roles in Oswald’s framing and in the cover-up after the fact.

    For Curtis to omit so many crucial facts about the JFK assassination, about Kerry Thornley, and about Garrison’s case is useful to his cause. It allows him to ignore the history-making interventions of the deep state and the extent to which these interventions have helped bring about the political nadir that America is experiencing. Curtis’ obscurantism allows him to downplay American state criminality as merely “political corruption”: the regrettable result of various technocratic bureaucrats holding and acting on bad ideas while trying to impose order on a chaotic and unpredictable world. He omits, distorts, and cherry picks facts to present his interminable exploration of our current dystopia. In so doing, CGYOMH obscures what may be the most salient historical development of the postwar US-led world order—the criminalization of the state.

    In Part 3, I will examine (1) how Curtis fails to reckon with the nature of the state in the West, (2) how this precludes him from grappling with the realities of US foreign policy, and (3) how this dovetails with his tendentious and chauvinistic depictions of the chief US rivals, Russia and China.

    The JFK Records – Will President Biden Obey the Law?


    If you are interested in the public release of the JFK assassination records, this is a critical point in time. If you have paid a little attention to this subject, the logical questions are: “Weren’t all the JFK records released in 2017 as required by the JFK Records Collection Act?” And, “Why is this a critical point in time?”

    The answer to the first question is that over 15,000 assassination records are still withheld partially or in full by the National Archives. The answer to the second question is that the President, the National Archives, and agencies still withholding these records are facing critical deadlines in 2021.

    You may be asking: “Why is the government facing critical deadlines in 2021, when all records were supposed to be released by 2017?” Here is what happened and I will also explain why the American public should be angry and demand action.

    As I’ve written about previously, the JFK Records Collection Act of 1992 (the “JFK Act”) required the full public disclosure of all assassination records by October 26, 2017. This was not a random deadline. The deadline was precisely twenty-five (25) years following the creation of the JFK Act, which required each assassination record to be publicly disclosed in full by October 26, 2017.

    The only way President Trump could sidestep this complete declassification was through written certification stating that:

    1. continued postponement was necessary because of an identifiable harm to the military defense, intelligence operations, law enforcement, or conduct of foreign relations; and

    2. the identifiable harm was of such gravity that it outweighed the public interest in full disclosure.

    As investigative journalist Jefferson Morley wrote about last month, some 15,834 assassination-related records are still withheld in full or in part by the Executive Branch and agencies who created these records.     So, what actually happened in October of 2017? A week before the October 26, 2017 deadline, President Trump tweeted that he was looking forward to the full release of the JFK assassination records and that all records would be released by the deadline. Well, that did not happen. Even worse, Trump and the Executive Branch blatantly violated the JFK Act. On the eve of the deadline, presumably after meeting with CIA Director Mike Pompeo, Trump issued an executive “memorandum” giving the federal agencies another six (6) months to comply with their obligations under the JFK Act. There was no mechanism or authority in the JFK Act for President Trump to do this. To justify postponement past October 26, 2017, Trump was required to issue a written certification explaining, for each and every record, why postponement was proper under the clear standards of the JFK Act. I have written in the past in detail about those clear standards. Essentially, Trump was supposed to explain in writing, for each record, why 1) continued postponement is made necessary by an identifiable harm to the military defense, intelligence operations, law enforcement, or conduct of foreign relations; and 2) why such identifiable harm is of such gravity that it outweighs the public interest in disclosure.

    Instead, on October 26, 2017, President Trump issued an executive memorandum stating that he had “no choice” but to continue postponement for an additional 180 days because of concerns over “national security, law enforcement and foreign affairs.” Trump, in regards to an assassination that occurred 54 years in the past, asserted that full public disclosure of the JFK Records would allow potentially “irreversible harm” to the Nation’s security. Trump then ordered all agencies to re-review each and every withheld record over that 180-day period and failing a demonstration from the agencies that a record met the standard for proper postponement under the JFK Act, public disclosure would be required for all JFK Records by April 26, 2018.

    A six (6) month delay was frustrating, but seemed reasonable given that the Executive Branch and agencies in charge of these records seemingly did nothing since the winding-up of the Assassination Records Review Board (ARRB) in the 1990’s. So, what happened? On April 26, 2018, based on a recommendation from the (National) Archivist, President Trump issued a second executive memorandum giving agencies an additional three (3) years to review withheld records and make recommendations to the Archivist regarding its intent to postpone disclosure past October 26, 2021. Yes, you read that correctly. October of 2021.

    In that memorandum of April 26, 2018, Trump claimed that all executive departments and agencies had complied with his prior order to review all information within postponed records and inform the Archivist of the specific reason(s) for continued postponement under section 5(g)(2)(D) of the JFK Act. He cites the “identifiable harm” standard from the JFK Act discussed above and then broadly states that he “agreed with the Archivist’s recommendation” that continued postponement is necessary under the standards of the JFK Act. He then ordered agencies again to “re-review” any redactions (in the records) or decisions on complete withholding over the next 3 years. While Trump’s April 26, 2018, statement contained the key “buzz words” in the JFK Act for decisions on postponement, this action again did not come close to meeting the standards of the JFK Act for postponement. By October 26, 2017, at the very latest, all government agencies were required to provide to the Archivist an unclassified “identification aid” stating the specific facts, based on clear and convincing evidence, warranting a legitimate postponement decision. Those facts must deal with a threat to current military or intelligence operations, a current living person or agent who would be at risk from disclosure of records, or other current sources and methods that required legitimate protection in 2018. President Trump essentially let the executive branch and other agencies skip over this critical identification step in the JFK Act, meaning that continued postponement past October 26, 2021 is almost a certainty due to a lack of accountability. Was skipping this step just lethargy, or is it a continued attempt to withhold assassination history from the public? The only way we will know is seeing the records.

    There has been no media attention on the most recent deadline, which was April 26, 2021. In Trump’s April 26, 2018 memorandum, he required each agency (that seeks postponement past October 26, 2021) to identify (to the Archivist) the specific basis for continued postponement under the JFK Act. The Archivist is supposed to make recommendations on continued postponement to President Biden no later than September 26, 2021. Then, President Biden will have 30 days to make final decisions on disclosure by October 26, 2021. This is very interesting because, according to Trump’s memorandum, all agencies had purportedly done their jobs by April 26, 2018, satisfied the Archivist, and then Trump supposedly had agreed with the Archivist’s recommendations on over 15,000 records. If this was the case, why did the agencies get another 3 years to do the same job? And how is the Archivist supposed to do the job by September 26, 2021 without the identification aids from agencies? And how in the world is President Biden supposed to finish the job in 30 days when September 26, 2021 arrives? The simple answer is that the President and the Archivist cannot do their jobs, because the executive branch and other agencies have seemingly ignored the JFK Act and Trump’s executive orders. If they are paying attention to the act and presidential orders, and not ignoring them, the clear reason for inaction is that the agencies don’t want the President, the Archivist, and the American public to know what is in the JFK records.

    If the status quo continues, it is easy to see how the President, the Archivist, and various agencies can keep using their “discretion” to continue these unjustified and illegal delays. They will continue postponement by making it appear that they are complying with the JFK Act, but they are really not. The public is entitled to unclassified and specified written reasons for postponement under specific criteria in the JFK Act. If there are legitimate reasons for postponement under the JFK Act, so be it. The law is the law and it is a very good law in terms of public interest and transparency when it comes to the JFK assassination. This article is not aimed at proving a conspiracy in the assassination. It is simply about compliance with the JFK Act and our government offices and agencies following the law.

    Fortunately, experienced researchers and attorneys are paying attention. Attorney Larry Schnapf has sent a letter and legal memorandum to Rep. Carolyn Maloney, chair of the House Oversight Committee, calling for oversight hearings and enforcement of the JFK Act. That letter can be viewed here: (jfkfacts.org)). I strongly encourage readers of this article to contact these Congressional committees in support of Mr. Schnapf’s excellent and thorough letter. Congressional oversight committees clearly have authority and a duty under the JFK Act to require action from the Executive Branch and government agencies that are withholding these records from the American public. The Public Interest Declassification Board (PIDB), which advises the President on declassification issues, intends to address the status of JFK Act compliance on May 18, 2021. That is a very good development. Hopefully the PIDB will properly advise President Biden on the clear standards of the JFK Act and the need for compliance.

    If Congress and the PIDB do not collectively act on this important issue, there are also legal remedies. I am working with Larry Schnapf and a group of attorneys to develop a plan for private legal action, should that become necessary. Our hope is that there is enough information before Congressional oversight committees and the PIDB, but considering the unjustified and illegal delays we have seen since 2017, there will be a plan in place to get the federal courts involved.

    The one thing I do agree with in Trump’s April 26, 2018, memorandum is the following statement:

    Any agency that seeks further postponement beyond this certification shall take note of the findings of the Act, which state, among other things, that only in the rarest cases is there any legitimate need for continued protection of such records. The need for continued protection can only grow weaker with the passage of time from this congressional finding.

    The President said this in 2018, when Congress had already declared in 1992 that postponement of records should be rare and that clear and convincing evidence was needed to withhold a record from the public.

    We have to remember that two government bodies concluded that Lee Harvey Oswald killed President Kennedy. In 1964, the Warren Commission (WC) concluded that Oswald killed Kennedy on his own and that there was no evidence of a conspiracy. The WC also concluded that there was no connection to the murder of Oswald by Jack Ruby. The House Select Committee on Assassinations (HSCA) also concluded in 1978 that Oswald killed Kennedy, but that there was a probable conspiracy involving two gunmen. The HSCA concluded in its final report that anti-Castro Cuban groups and organized crime, as a group, did not assassinate Kennedy. But the HSCA also concluded that “the available evidence does not preclude” those possibilities. If one or both of these government bodies’ conclusions are correct regarding the JFK assassination, there should have been no legitimate reason for postponing release of records in 1978. In 1992, Congress then declared that protection of JFK Records was legitimate only in the rarest of cases. In 2017 and 2018, it would seem ludicrous for the President and the Archivist to continue to find proper reasons for postponement, especially when you consider the conclusions of the WC and HSCA. Yet, the Executive Branch and agencies got 3 more years to “re-review” the JFK Records. April 26, 2021, has come and gone with no announcement from President Biden or the Archivist confirming that the work has been done by the agencies. Congress has yet to hold any oversight hearings to ensure compliance. Enough is enough, especially after 58 years.

    Deep Fake Politics: Getting Adam Curtis Out of Your Head


    Filmmaker Adam Curtis is a strange figure. He is a skilled film-maker with a unique—if by now cliché—style. His films delve into areas often ignored by “mainstream” media. In that way, he appears to be someone who explores deep politics, the term Peter Scott coined to describe “all those political practices and arrangements, deliberate or not, which are usually repressed rather than acknowledged.”[1] However, as someone steeped in deep political scholarship, Curtis’ omissions and distortions are glaring and egregious. These flaws are very much on display in his latest BBC series, Can’t Get You Out of My Head (hereafter CGYOMH).

    The series is eight hours long and, as such, this review will focus on select key areas—specifically those related to Curtis’ tendentious approach to issues and historical episodes that fall within the realm of deep politics. These topics include his approach to Western finance, his dismissal or obfuscation of state crimes/elite conspiracies, as well as his smug and derisive approach to the West’s enemies du jour (most notably China and Russia). A recurring theme is the fecklessness of Adam Curtis in terms of identifying villainous actors and how they might be confronted for the benefit of humanity. Eventually, this multi-part review will conclude with an assessment of his work and what it reveals about his politics. At the risk of spoiling the conclusion, CGYOMH and Curtis’ other trippy films offer the audience not an illuminating “red pill,” but rather a BBC-approved red placebo.

    Curtis opens CGYOMH with a quote from David Graeber: “The ultimate hidden truth of the world is that it is something that we make and could just as easily make differently.” I have some admiration of Graeber, but I find him an odd choice for Curtis to quote given Graeber’s left-anarchism and Curtis’ carefully contrived “apolitical” posture. Said Curtis to an interviewer, “People often accuse me of being a lefty. That’s complete rubbish. If you look at The Century of the Self, what I’m arguing is something very close to a neo-conservative position.”[2] He also said, “If you ask me what my politics are…I don’t really have any.”[3] Of course, being anti-left is not apolitical, but I digress.

    The world “is something that we make.” This formulation might be useful in a poetic sense. It is obviously a pithy restatement of humanism. Human societies have been created by humans. The ultimate truth of, say, an anthill is that it is made by ants and ants could just as easily make it differently. Unfortunately, and as Graeber would likely agree, the story of civilization is not a rosy tale of shared sacrifice and shared rewards. Civilization has always been predicated on hierarchy—on expropriation and exploitation. Civilization only advanced thanks to exploited persons, the fruits of whose labor allowed others to engage in other activities besides acquiring food. That said, as material capacity improves, civilization offers the means for enlightened progress.

    This fundamental, unresolved contradiction of human civilization should be at the center of any deep investigation into fundamental systemic problems. Alas, this is not the case for CGYOMH. Unlike Curtis, I don’t feel a need to disingenuously claim that I have no perspective on politics and/or history. If pressed, I would describe myself not as a Marxist, but as a Millsian, i.e., a scholar working in the tradition of the sociologist C. Wright Mills. That said, in 2021, it is harder to gainsay Marx’s overarching critiques of capitalism and class structure across time and space. Even Plato, centuries earlier, recognized much of this—though he deemed his insights so dangerous that he used fictional sock puppets like Socrates and Thrasymachus to make his points. Plato’s hypothetical myth of the metals was an acknowledgement of the necessity for stratification—and for the myths that must be deployed to obscure the injustice of it all. Similarly, the allegory of the cave can easily be read as an elitist argument for the technocratic manufacture of consent. Plato, by this reckoning, acknowledged the primacy of class…and saw it as desirable, or at least unavoidable.

    However, as stated above, civilization also offers redemption through enlightenment—the presumptuous control of our fate by way of human reason. My own study of deep politics has led me to conclude that under US hegemony, Western “liberal democracy” has failed to fulfill the promise of the Enlightenment. More precisely: state secrecy, the extreme concentration of politico-economic power, and high criminality have created a despotic anti-democratic system of top-down governance. We live under a political regime obscured and protected by the totalizing corruption and/or co-opt-a-tion of the liberal institutions that supposedly allow for democratic sovereignty. For us to arrive at solutions to our civilization’s crises, we must understand how and why we have arrived at this juncture. Such an undertaking requires a historical narrative. A narrative is, of course “a story,” something that Curtis repeatedly tells viewers is very dangerous. He repeatedly makes some variation of this claim throughout his own films, i.e., through his own stories.

    Curtis and “His Story”

    There are major problems with Curtis’ history, in particular his historical rendering of postwar US hegemony. In the 1950’s, C. Wright Mills wrote about two ideal types of history—drift vs. conspiracy. The older version of history as drift was history as “fate” or “The Unseen Hand.” This is tantamount to imagining the tale of Oedipus as something of an allegory for human history. The contemporary social science version of this is history as “drift” wherein innumerable human decisions collectively produce historical outcomes that no person or persons could have controlled.[4] Wrote Mills, the “view that all is blind drift is largely a fatalist projection of one’s own impotence, [or] a salve of one’s guilt.” The problem with this perspective is not all historical moments are so anarchic. What if the circle of elites with decisive history-making power is rather narrow and centralized, and what if the decisions of these elites are of great consequence? In such a context, history-making power may rest within circles of actors that are known or at least knowable.[5]

    Mills’ second problematic ideal type imagines history as “conspiracy.” This perspective maintains that history plays out along lines determined by compact sets of villains or heroes. Such views represent the failure to attempt the more challenging task of grappling with the ways in which evolving social structures provide opportunities to an elite of power which may or may not capitalize on them. Argued Mills, “To accept either view—of all history as conspiracy or all history as drift—is to relax the effort to understand the facts of power and the ways of the powerful.”[6]

    To restate: both ideal types—drift and conspiracy—are flawed. Elites do collaborate in the creation of history-making decisions, but they do so within various structural, historical, and institutional contexts. As Mills pointed out, the postwar US power elite were “Commanders of power unequaled in human history.”[7] In social science terms, the historical ideal types of drift/conspiracy are analogous to issues of structure/agency. How much can various outcomes be explained by structural factors or by human agency? Both factors can have more or less weight in different situations.

    The overwhelming postwar material power of the US vis-à-vis the rest of the world was a structural fact. That structural reality bequeathed to US policymakers tremendous agency—agency that was deployed to create the structure of the international capitalist system. This is structural power,[8] i.e., “agency of the highest order.”[9] Curtis fails to adequately examine just how and why postwar US elites successfully wielded this structural power to establish the subsequent liberal imperial order. Instead, he repeatedly focuses on marginal characters or bureaucrats or technocrats or those whose ideas inform various actors at the middle levels of power. In this way, Curtis time and again obscures the elite origins of the various ideas and techniques deployed by middling actors to serve power. Curtis thus functions as something of an anti-Mills, ignoring the sociologist’s assertion that a “master task” for intellectuals should be: “To confront the new facts of history-making in our time, and their meaning for the problem of political responsibility.” Curtis does the opposite, but in a stylish and disorienting way which serves to conceal his propagandistic function.

    This is not to state that he does so intentionally; I am agnostic on that score. However, if Curtis suddenly abandoned his myopia toward the power elite, he would likely find that he was no longer welcome on the BBC and his work would not likely be reviewed favorably by the prestige media.

    CGYOMH and the “American Century”

    Given the systemic crises that Curtis explores in CGYOMH, he would have been wise to devote some of the film’s eight-hour run-time to the origins of the US-led world order whose present decrepitude he documents. During and after World War II, there were debates over what to do with America’s historically singular position of unrivaled dominance. Wall Street’s Council on Foreign Relations (CFR) wanted an “American Century,” i.e., hegemony over the international capitalist system. Daniel Ellsberg aptly terms this covert empire—empire that does not acknowledge and actively obscures (to the extent possible) its imperialism.[10] This global imperialist turn was opposed by some at the time, most famously Henry Wallace, FDR’s vice president. Opposing the “American Century” proposed by CFR man Henry Luce,” Wallace instead called for a “Century of the Common Man” in which,

    No nation will have the God-given right to exploit other nations. Older nations will have the privilege to help younger nations get started on the path to industrialization, but there must be neither military nor economic imperialism. The methods of the 19th century will not work in the people’s century which is now about to begin.[11]

    Wallace’s defeat may have been inevitable. The forces driving US imperialism conspired against him at the 1944 Democratic convention. As Oliver Stone and Peter Kuznick describe in The Untold History of the United States, he was dropped from the Democratic ticket despite being the second most popular US politician at the time—behind only Franklin Roosevelt himself. Progressive internationalism was abandoned. Instead, the only viable foreign policy positions were confined to “containment” or “rollback”—both products of men in the service of Establishment scion Dean Acheson—respectively, George Kennan[12] and Paul Nitze.[13]

    The CIA was created with communism as its ostensible foil. Behind the scenes, the Agency was created largely at the behest of Wall Street forces.[14] Though the US did preside over a process postwar “decolonization,” the Cold War served as cover for neocolonialism—the preservation of colonial economic relationships without formal colonization. By 2021, it should be obvious that—because of the historical continuity it represents—the Cold War offered a massive structural pretext for neocolonialism. How much difference is there between early 20th century US imperialism, the Cold War, and the post-Cold War era? Think of the earliest so-called “banana republics,” the Cold War CIA Operation PBSUCCESS which overthrew Guatemalan democracy at the behest of United Fruit, the 1964 coup in Brazil, or the 21st century “lawfare” coups in Brazil which took Dilma Rousseff and Lula de Silva out of politics. It is one of the straighter lines that can be found in history and social science.

    While discussing many episodes involving covert operations and foreign policy debacles, Curtis largely ignores the driving, discernable corporate interests. These interests animated the CIA at its inception and throughout its existence. The pithy truism that “the CIA is capitalism’s invisible army” goes unacknowledged—the implication being that these criminogenic organizations are just more examples of the misadventures of misguided technocrats possessed of troublesome ideas.

    Monetary Myopia

    On money and finance, CGYOMH is at its obscurantist worst. Curtis acknowledges that in 1971 Nixon ended Bretton Woods, though he doesn’t name it. CGYOMH does explain that the period of fixed exchange rates was ended. Curtis also doesn’t adequately explain the crucial fact that while the soft gold standard of Bretton Woods was abandoned, the dollar was not. Once this post-Bretton Woods regime was consolidated, it allowed the US to run historically unprecedented balance-of-payments deficits without suffering inflation. The dollar and the US Treasury Bill replaced the role formerly played by gold, but without the limitations imposed by the scarcity of Gold. This “gave the US the Rumpelstiltskinian power to create credit that the rest of the world would have to treat as being ‘as good as gold.’”[15] It is hard to overstate the extent to which the establishment of this regime represented both the use and acquisition of enormous structural power for the US.

    It was Vietnam War spending that created the deficits that killed Bretton Woods.[16] In CGYOMH, Curtis states flatly that Vietnam caused the economic problems and the inflation of the 1970’s. However, chronological correlation does not imply causation. The Vietnam era was an economic boom period for the US. There was indeed a dollar glut in foreign banks which necessitated systemic adjustment, but this could have been addressed in different ways. Instead, it was resolved by closing the gold window and later by way of the “oil shocks.” The explosion in the price of oil did cause some economic problems for the US public. But here again, Curtis errs on the side of obfuscating conspiratorial elite malfeasance. He states that in 1973, Middle Eastern leaders “decided to use oil as a weapon…to force America to stop supporting Israel.” But as Gowan[17] and Varoufakis[18] point out, this explanation was essentially a cover story. The explanation Curtis puts forward,

    …runs counter to logic and evidence. For if the Nixon administration had truly opposed the oil price hikes, how are we to explain the fact that its closest allies, the Shah of Iran, President Suharto of Indonesia and the Venezuelan government, not only backed the increases but led the campaign to bring them about? How are we to account for the administration’s scuttling of the Tehran negotiations between the oil companies and OPEC just before an agreement was reached that would have depressed oil prices?[19]

    This is further corroborated by the former Saudi oil minister, Sheikh Ahmed Zaki Yamani, who told The Guardian that,

    I am 100 per cent sure that the Americans were behind the increase in the price of oil. The oil companies were in real trouble at that time; they had borrowed a lot of money and they needed a high oil price to save them.[20]

    The Shah of Iran—a CIA-installed dictator—told Yamani, “Why are you against the increase in the price of oil? That is what they want? Ask Henry Kissinger—he is the one who wants a higher price.”[21] In addition, secret Saudi agreements with the Nixon administration established that the kingdom would use oil revenues to buy US Treasury bills at special auctions,[22] and that Saudis would only sell oil in US dollars.[23]

    The final gambit to cement the post-Bretton Woods regime was the massive increase in interest rates. Bowing to David Rockefeller’s advice, Jimmy Carter tapped Paul Volcker to chair the Federal Reserve. Volcker then drastically raised interest rates. Though this was harmful to much of the US public, it served to stabilize the global financial system in such a way as to secure for the US the most “exorbitant privilege” in world history—ownership of the global reserve currency backed by nothing.

    The takeaway here is that Curtis is wrong on a crucial matter when he states in the third episode of CGYOMH that Nixon created a new global monetary system “by accident” and that the OPEC nations and Western bankers had themselves created an economic system beyond the control of politicians. In fact, the US government actually had enormous control over the monetary system, as well as the historically unprecedented ability to run massive to budget deficits to address any priority or social problem. This enormous economic power has studiously not been utilized for the benefit of most Americans. Through massive obfuscation of the true nature of American structural power over the global economy, the US public has been kept largely ignorant of the democratic state’s abdication of controlling authority over the domestic and international monetary system. This can be described as a central manifestation of American antisocialism—the prevailing US tendency to crush democratic political forces which would subordinate capital to human society rather than vice versa e.g. Wallace, and Bernie Sanders.

    In 1978, Paul Volcker—one of the first officials to call for the abandonment of Bretton-Woods—gave a speech admitting that, faced with collapse of Bretton Woods, the US privileged the retention of “freedom of action for national policy” over the creation “of a stable international system.” This speech was delivered shortly before Volcker’s appointment by Jimmy Carter to chair the Federal Reserve. In this same speech, Volcker stated that “controlled disintegration in the world economy is a legitimate objective for the 1980’s.”[xxiv] How did this play out? The enormous volume of petrodollars that flowed into US banks allowed for massive loans to the formerly colonized nations of the Global South. By the mid-1970’s, these nations were extremely vulnerable to any increase in interest rates. The massive Volcker interest rate hike led to the Third World debt crisis.[25] Writes Varafoukis,

    The IMF happily offered to lend money to governments for the purposes of repaying the Western Banks, but at an exorbitant price: the dismantling of much of their public sector, the shrinking of the newly founded state institutions, and the wholesale transfer of valuable public assets to Western companies. [The] crisis was the colonized world’s second historic disaster…from which most Third World countries have never quite recovered. [It all] proved more effective in destroying the enemies of US foreign policy around the globe than any military operation the US could ever mount.[26]

    The consolidation of this monetary regime was manifest in the so-called “Washington Consensus.” It was in this context that China entered as a major actor in the world economy. Here again, Curtis errs in such a way as to obscure Western imperialism and elite perfidy while conveniently depicting the West’s adversaries in a harsh light. In the fifth episode of CGYOMH, Curtis addresses the Asia crisis of 1997 and 1998. He discusses how a speculative bubble burst, resulting in capital flight and severe economic downturns for the effected countries. He states that the IMF tried to help, but (surprise!) their prescriptions just made things worse. Curtis even shows Malaysian prime minister Mahathir Mohamad denouncing the Western powers behind the corruption of global financial markets.

    However, the film fails to mention that Malaysia weathered this crisis remarkably well by doing the exact opposite of what the US-dominated IMF prescribed: the country enacted stringent capital controls to prevent capital flight that would have destroyed the country’s currency and thus its economy. Since this goes unmentioned, there is no need to explore the probability that these misguided IMF measures actually enrich Western economic interests through the impoverishment of other countries—by design.

    The Chinese Culprits

    After this myopic and obscurantist discussion of the Asia crisis, Curtis turns to his favorite bête noire, China. As Curtis describes it, Jiang Zemin—apparently a unitary actor with sole command over the Chinese state—decided that China would recycle its dollar surpluses into US treasury bills in order to keep its currency weak. This boosted China’s exports and strengthened the US dollar. China’s policy also allowed the US to keep interest rates low, flooding the US with cheap credit which would allow US citizens to buy even more goods produced by the scheming Chinese. This allows Curtis to essentially blame China for the bubble economy that emerged in the US, leading the poor Americans into “a protective dream world that was increasingly detached from the reality outside.” But as Michel Hudson often speaks and writes about, and as is delineated above, the system was designed to make surplus countries do exactly what the Chinese were doing: recycle dollars into US treasuries.[27] Cue Curtis’ nutty footage of a confused-looking George W. Bush walking around in a blue Zhongshan suit.

    If surplus countries like China do not invest in US treasuries, their currency will rise in value and damage their export economies. This demonstrates the remarkable fact that the US is able to dominate the global economy through its position as the biggest debtor in human history. Furthermore, for all the “free trade” mythology about the US, the country has refused to allow the Chinese to invest those dollars in key US companies. For example, the US government quashed a Chinese bid to acquire the oil company, Unocal, for $18.4 billion.[28]

    It is absurd for Curtis to suggest that Chinese machinations are responsible for the various speculative bubbles in the US economy. And it is risible to imply that the dystopian George W. Bush years were also somehow related to devious Chinese plots. In fact, China is well aware that by helping finance America’s massive military budget, the country is financing its own military encirclement. The Chinese are increasingly looking for ways to escape the dollar system without destabilizing their economy. The mandarins of US imperialism are acutely aware of this and have explicitly called for making sure that China cannot do any such thing. The US/NATO imperial brain trust known as the Atlantic Council recently issued a manifesto entitled “The Longer Telegram.” This is a straight steal from George Kennan’s 1946 Long Telegram, which explained the policy of containment toward the USSR. This time the warning is about China’s ambition to “undermine US dominance of the global financial system and the status of the US dollar as the global reserve currency.” The paper called for policymakers to “protect the global status of the US dollar.”[29]

    In 2003, US President George W. Bush—or Xiao Bushi (Little Bush), as the Chinese call him—launched the Iraq War. US leaders, as Curtis would have it, were presumably influenced in part by the dream-like state that China had contrived to addle the usually sensible and peaceful Americans. Curtis notes that while Vietnam caused inflation and political unrest, the Iraq War produced no such effects. Why? China, of course. With their nefarious purchasing of US Treasuries, CGYOMH implies, the Chinese have forestalled and/or sabotaged the political reckoning that liberal democracy is designed to produce.

    As for the lack of political unrest caused by Iraq—which really is not true, but let us grant it for the sake of argument—a responsible commentator might want to mention that unlike the Vietnam era, there were no Americans drafted to fight in Iraq. Additionally, the US waged the Vietnam War as the hegemon of the Bretton Woods system. Due to that system’s gold peg, the astronomical war spending did impact the US economy. With historic high-handedness and imperial hubris, the US defaulted on its obligations by unilaterally discarding Bretton Woods. Said Secretary Treasury John Connolly at the time (yes, that John Connolly), “It’s our currency, but it’s your problem.”[30]

    So while Curtis would like to blame China for US irresponsibility, the obvious fact is that it wasn’t China, but the post-Bretton Woods petrodollar/US Treasury-bill standard[31] that allowed the US to prosecute the Iraq War without experiencing the disastrous economic consequences that nations historically suffer after launching expensive military adventures. It was this same dynamic that allowed Reagan to slash taxes for the rich while exploding the military budget. This is why Dick Cheney famously said, “Deficits don’t matter.” He was largely correct, but this obviously belies the GOP/neoliberal Democrat austerity consensus, so it went substantively unexplored by the press.

    The Sub-Prime Crisis, Adam Curtis-Style

    As we should expect by the final episode of CGYOMY, Curtis does not handle the sub-prime crash very well either. Those foolish bankers and technocrats thought their data modelling and algorithms could effectively manage all risk. On the ground, this led to massive amounts of unrepayable loans being made to poor people who couldn’t pay it back. While Curtis does reveal the scandalous fact that the massive bank losses were transferred to the public domain, he does not reveal to his audience that the government could have bailed out homeowners for a fraction of the cost of bailing out the fraudulent banks. Writes Michael Hudson:

    You hear no talk from Mr. Paulson or Mr. Bernanke about bailing out homeowners by writing down their debts to match their ability to pay. This is what economies have done from time immemorial. Instead, the Republicans—along with their allied Wall Street Democrats—have chosen to bail out investors in junk mortgages presently far exceeding the debtor’s ability to pay, and far in excess of the current (or reasonable) market price. The Treasury and Fed have opted to keep fictitious capital claims alive, forgetting the living debtors saddled with exploding adjustable-rate mortgages (ARMs) and toxic “negative amortization” mortgages that keep adding on the interest (and penalties) to the existing above-market balance.[32]

    The result of the sub-prime bailouts was a massive upward shift of wealth and millions of evictions across the US. JP Morgan reportedly said that in an economic downturn, capital “return[s] to its rightful owners.” Firms like Blackstone benefitted from the American state’s largesse toward finance and the penury of former homeowners by buying up massive amounts of foreclosed properties. In 2020, Fortune reported that Blackstone had become “the world’s biggest corporate landlord,” with control of property worth a collective $325 billion.[33]

    Given these outcomes, it begs the question as to whether or not those at the pinnacle of wealth and power really would consider the affair to be a terrible mistake. While the crisis was devastating for the US public, high finance benefitted enormously. Banks made vast profits through control fraud as the bubble expanded. After all, loans created essentially out of thin air are what banks “sell.” Huge bonuses were paid on the basis of fraudulent lending practices. While the public may be ignorant of the structural power bequeathed by the Petrodollar/US T-Bill Standard, the people who run the Federal Reserve, the US Treasury, and the Too-Big-to-Fail/Jail banks are most certainly aware. The last scene of the film Margin Call neatly illustrates this protective scheme as Jeremy Irons says the crash will not hurt his company that much since the federal government will bail them out, which, in large part, they did.

    The opacity of the higher circles means that we are never likely to know the extent to which the subprime crisis, subsequent bailouts, and failure to prosecute the fraudsters collectively represent something of a rolling deep state coup by a financial Power Elite. Suffice it to say that we should all be so lucky as to spectacularly “fail” in such a way as to effect an historically monumental transfer of wealth to ourselves.

    The Deep State Financial Elephants in the Room

    If Curtis wanted to honestly report on big money’s takeover of politics and society, he could tell us about Blackstone, or more importantly, the “Big Three” capital firms—BlackRock, Vanguard, and State Street. As Paul Jay reported,

    Financialization of the economy produced two shadow banks that tower over the rest of the corporate world. Blackrock and Vanguard with other smaller money management firms, control 90% of the S&P 500 public companies, including fossil fuel companies, arms manufacturers and major U.S. media outlets that own ‘mainstream’ news. The top three financial services firms manage 15 trillion dollars of assets. That’s more than China’s 2019 GDP. Blackrock is the largest with 7.4 trillion, followed by Vanguard at 5.3 trillion and State Street Global Advisors at 2.5 trillion.[34]

    This massive concentration of politico-economic power is another crucial aspect that Curtis obscures. The hegemony of organized money over society did not arise by accident. It involved a series of coups d’etat profonde, or strokes of the deep state. In my dissertation, I defined the deep state as,

    …the various institutions that collectively exercise undemocratic power over state and society. Pluralistic to varying degrees, the deep state is an outgrowth of the overworld of private wealth. It includes most notably the institutions that advance overworld interests through the nexuses connecting the overworld, the underworld, and the national security organizations that mediate between them.[35]

    I would add that deep state can also refer to what is often called “the Establishment,” i.e., those parties whose political dominance has “been institutionalized via the cooptation or subversion of state, civil society, and liberal institutions. In this broadest sense, elements of organized religion, the educational system, the corporate media (and much of the ‘independent’ media) can be considered part of the deep state.”[36]

    By putting forward conventional or benign, idiosyncratic explanations of historical events—and by failing to interrogate deep political intrigues—Curtis lets culpable elite actors and institutions off the hook. This is beguiling and ultimately disempowering. The same can be said for his various critiques of technocrats and their “misguided” notions—wrongheaded ideas whose invariable usefulness to the politico-economic elite is typically obscured or regarded as coincidental. And of course, this criticism also applies to his oft-conveyed lament that the solipsistic foolishness of random persons is somehow to blame for the prevailing political dystopia we are living through. Given what has changed in US society since World War II, it is more accurate to blame the elites, and their American anti socialism, for the purposeful incremental neutering of American democracy.

    Caitlin Johnstone, JFK, and the Insurrection


    Caitlin Johnstone is one of my favorite journalists. She is well-informed, bright, witty, and her sympathies are in the right place. In fact, we write for two common publications: the online Consortium News and S. T. Patrick’s paper magazine garrison.

    As everyone knows, January 6, 2021, will go down in history as one of the most frightening days of the new millennium. The only thing I can compare it to is the so-called “Brooks Brothers riot,” that took place in Dade County in 2000 that helped give George W. Bush his illegitimate presidency. That, of course, was not really a riot. It was arranged by people like Congressman John Sweeney and Republican political operative Roger Stone. The idea was to stop a recount of votes in the Miami area that would have likely given the election to Vice-President Al Gore. Through violent and intimidating means, it succeeded in that aim.

    What happened on January 6, 2021, was much more lethal. So far eight people have passed on because of that insurrection. Five died as a direct result of the violence and three took their own lives afterwards: two policemen and one man who was about to be arrested. Caitlin Johnstone has been trying to tell her audience that we should discount what happened on that day; it really was not an attempt to overturn the election and thereby keep President Trump in power. (Click here for details) Besides that, she says if we did maintain it as such, we may unleash something even worse; like attacks on and censorship of the web and social media. This could be used against progressives.

    Again, let me reiterate, I like Caitlin. But I beg to disagree with her about this importance of this event. To me, that scene at the Capitol resembled the climactic, surreal riot scene from Nathaniel West’s The Day of the Locust. It was so disturbing that I went out and bought a 12-pack of beer to dull the pain of watching it. To me, it is not something to discount or try to forget anytime soon. How does one forget a gallows constructed across the street from the Capitol while the insurrectionists were looking for Vice President Pence? Another insurrectionist was looking to shoot House Speaker Nancy Pelosi. Representative Alexandria Ocasio-Cortez said that, while in hiding, she literally feared for her life. (Click here for details) She should have, since another insurrectionist has now taken back his threat to shoot her.

    We, who study the John F. Kennedy assassination, should be able to point out certain similarities that betray the event as not simply a spontaneous Westian outburst. The night before at a “Stop the Steal” rally in front of the Supreme Court, Roger Stone compared Trump to Abraham Lincoln and cheered on the crowd by saying the president had “Freed This Slave!” (Click here for details) There were credible reports that there were explosives set outside both the Democratic and Republican National Committee headquarters. Investigators later theorized that the alerts about these bombs were diversions, meant to distract police from the marching crowd, but there were not many police on hand to distract. Because, as with the security stripping around President Kennedy in Dallas, there was definitely a real problem in supplementing the terribly outnumbered Capitol Police force. (Click here for details)

    Authors Michael Kurtz and the late John Davis noted reports of people being in Dealey Plaza and looking like they were lining up targets two days before the assassination. (Kurtz, Crime of the Century, second revised edition, p. 218) In the January 6th case, there are various reports by congressmen that fellow representatives were showing people with MAGA hats around the building in the days before the insurrection. One of the “Stop the Steal” rally organizers, Ali Alexander, admitted that he received help from three representatives in organizing the insurrection. (Click here for details) At least one of the men Alexander named—Representative Mo Brooks—spoke at the rally on the Ellipse before the insurrection. The two others named by Alexander reportedly requested pardons from Trump before he left office. (Click here for details)

    This would seem to suggest that the insurrection was, at least partly, an “inside job.” There are numerous parallels to this in the JFK case. I will name just two. On the recovered Air Force One Tapes, General Curtis LeMay’s aide de camp is seeking him right after the assassination, as LeMay is flying in from Toronto to Washington DC . The Air Force officer was reportedly seen at the autopsy that evening. (Click here for details) In the film, The Parkland Doctors, there is witness testimony that either a Secret Service man or an FBI agent pulled Dr. Malcolm Perry aside after he told the press that Kennedy had been shot from the front. This man told Perry, “Don’t ever say that again!” This was about 90 minutes after the assassination.

    While the insurrection was in progress and a mob was seeking Pence, Donald Trump and Rudy Giuliani were not seeking to quell the violence. They were calling in to the besieged Capitol, trying to locate certain senators in order to attempt to stall the tallying of the Electoral College final vote. (Click here for details) This recalls the military interference with the official JFK autopsy, exposed by Dr. Pierre Finck at the trial of Clay Shaw in New Orleans.

    What should make all of the above even more distressing is that the January 6th insurrection was not, as Caitlin would like to characterize it, an outlier. Six men have been indicted in a plot to kidnap Democratic Governor Gretchen Whitmer of Michigan. That indictment was handed down just over two weeks before the insurrection. (Click here for details) As people in the JFK field know, there was an attempt to kill President Kennedy in Chicago about three weeks before he was gunned down in Dallas.

    As readers of this site will recall, I criticized historian Steven Gillon six weeks before the insurrection. He had written an editorial for the Washington Post saying that those who had tried to create confusion over the results of Trump’s election loss were doing so under the influence of the late Mark Lane. (Click here for details) I replied that Gillon was utterly wrong on this. The section of the populace espousing such subterfuge seemed to me to originate with the rightwing followers who had fallen prey to the Red Scare demagoguery of Joe McCarthy, Roy Cohn, and later, the fruitiness of the John Birch Society. From the results of January 6th, I was correct on this and Gillon was wrong. I await his apology. But since Gillon worked on the JFK case with the likes of Dale Myers, I know I will not get one.

    President Kennedy was fully aware of the burgeoning power of these ultra conservative minions. He had requested reports on them, made speeches against them, and fully understood how they hindered what he really wanted to do as president. After UN Secretary General Dag Hammarskjold was murdered—and Kennedy had received reports that such was the case—Kennedy called in a Swedish diplomat to pay his respects. Kennedy told him that, in his opinion, Hammarskjold was the greatest statesman of the 20th century. He could never equal that stature, because he had to worry about the power of these reactionary forces and their leaders in the United States. I will point out two examples. Domestically, General Edwin Walker and the John Birch Society had organized the demonstration at Ole Miss to stop James Meredith from integrating the university. This turned into a full scale riot which killed two people. As many researchers have written, Kennedy was planning his withdrawal from Vietnam around his re-election in 1964. He felt he had to, since he told his confidantes he knew he would be pilloried as an appeaser if he did it beforehand. (Ken O’Donnell and Dave Powers, Johnny We Hardly Knew Ye, p. 16) Finally, we all know how upset JFK was when he read the infamous black-bordered negative advertisement against him in the Dallas News on the morning of his death. He told his assistant Dave Powers not to let his wife see it. (Ibid, p. 24)

    This movement has mushroomed in recent decades (e.g. QAnon). On January 6th, they came armed and dangerous. Since the security on the Capitol was so unprepared, only about 70 people were arrested that day, but the arms cache discovered was formidable. It included IED bombs, Molotov cocktails, assault rifles, thousands of rounds of ammunition, a crossbow, brass knuckles, stun guns, and “stinger whips.” (Click here for details) There were reports that some of them brought climbing equipment. God knows what would have been recovered if there would have been a systematic search of all the perpetrators. How can one dismiss an armed, frenzied mob that was searching for people to execute, especially when it had been warmed up by previous demonstrations?

    In mid-November, the Proud Boys had arranged a march in Washington. During the rally, Trump drove past in his motorcade. That evening after fights had broken out in the street, Trump tweeted, “ANTIFA SCUM ran for the hills today when they tried attacking the people at the Trump Rally, because those people aggressively fought back.” (Talking Points Memo, 1/25/21, by Tierney Sneed and Matt Shuham, hereafter referred to as TPM) On December 5th, at a rally in Georgia, attorney Lin Wood and former NSC member Mike Flynn endorsed a call for martial law. Wood tweeted that the governor of Georgia and the secretary of state would “end up in jail,” if they did not help Trump overturn the election. (TPM)

    On December 12th, there was another “Stop the Steal” rally in Washington DC. At this one, Trump did a helicopter flyover as the organizers pleaded for him to call up a citizen militia “now while he is commander in chief.” (TPM) That evening, there were several stabbings and over a dozen arrests, as the Proud Boys set aflame Black Lives Matter banners which had been torn down from historically Black churches. (ibid)

    At about this time, political activist Amy Kremer of Women for America First began a bus tour through the south, including the deep red states of Tennessee, Kentucky, and Louisiana. She and other speakers would arrive in a red bus, marked with large white lettering: “March for Trump.” The idea was to recruit the crowd for January 6th. Kremer’s effort was in large part financed by Mike Lindell, the CEO of My Pillow company and a vociferous Trump backer. Kremer would stop and then speak at a prearranged gathering from a stage. She would say, “It is up to you and I to save this Republic. We are not going to back down, are we?” (Reuters, 1/11/21, story by Joseph Tanfani) These Kremer rallies were televised by the Right Side Broadcasting Network. That network was started for the purpose of giving Trump’s rallies more broadcast exposure. On December 19th, Trump tweeted for his followers to be at the Ellipse on January 6th.

    In addition to Kremer’s group, Charlie Kirk of Turning Point Action also sponsored the January 6th rally. This is a conservative campus student group. Kirk also helped finance seven busloads of students in his group to attend the rally. (ibid)

    To say the effort paid off is putting it mildly. The rally itself had to have been attended by tens of thousands. The Trump clan was assembled in what appears to be a tent off of the Ellipse, monitoring the crowd through TV screens. They are laughing and joking while urging Mike Pence to do the right thing. If you have not seen this video, you should. (Click here for details) All the while the late Laura Branigan is singing her smash hit “Gloria” in the background. (CNBC report of 1/8/21 by Dan Mangan)

    During the rally, the two main speakers were Trump and his attorney Rudy Giuliani. One can cherry pick parts of their addresses, in order to defend both men. But taken as a whole, I think there is little doubt that those two speeches caused the crowd to march to the Capitol under Giuliani’s pretense of “trial by combat.” The aim was to somehow pressure the House, the Senate, and Pence to reject the electoral college vote tally and send it back to the state legislatures to be reconsidered. There had been a prior attempt to do this in 1960 by certain deep south electors who did not want Kennedy in the Oval office, but would have accepted Lyndon Johnson with Kennedy as his VP.     What makes this maneuver a bit bracing is this: Giuliani had prepared for it by visiting certain gatherings of state legislators and briefing them on how the election had been stolen by Biden’s allies from Trump. (TPM) Some of the states visited were Pennsylvania, Michigan, and Georgia. In the first instance, Trump spoke to the legislators directly by speaker phone.

    The problem with all these pre-planned efforts to claim a stolen election is this: Trump could not even get his own elections supervisors to back them. Chris Krebs is a lifelong Republican who had worked security for Microsoft before coming to Washington. He was Director of Cybersecurity, meaning that, if asked, he would check all voting systems states used in advance. His goal was to get as close as possible to a complete paper ballot back up system. He decried Trump’s claims of voter manipulation. He stated under oath that the 2020 presidential election was “the most secure in American history.“ Before the senate, on December 16th, he took the time to debunk several of Giuliani’s specific claims. He was fired. Bill Barr, Trump’s Attorney General also refused to back him. He was forced to resign. Trump tried to get the officials in Georgia to go along with his fraud claims. After all, Georgia’s votes had been recounted three times. There is a now famous recorded phone call of the president talking to Georgia’s Secretary of State, Brad Raffensperger, asking him to “find” 11, 800 votes for him. Raffensperger declined to cooperate. After the call, Gabe Sterling, his chief operating officer, took the time to, again, debunk individual claims. He later showed how Giuliani had edited a tape to make it mean something it did not. He concluded one of his press conferences by saying all of these propagandistic and incendiary claims were going to result in someone getting hurt, shot, or killed. He was correct.     But perhaps the most surprising scheme that Trump dreamt up did not surface until recently. Apparently, Trump was going to also terminate his acting Attorney General Jeff Rosen. He would replace him with Jeffrey Clark, because Clark was willing to do what Rosen would not: pressure lawmakers in Georgia to overturn their election results. The only reason this did not come to pass is there was a threat of mass resignations in the Justice Department if it did. Trump did not want to face a reprise of the infamous Saturday night Massacre of Richard Nixon. (Seattle Times, 1/24/21) But part of the plan seems to have been enacted, since Trump did replace the US attorney in Atlanta after he would not go along with the scheme.

    In light of the above, I personally think it is untenable to try and maintain that there was not a serious effort in the White House to overturn the results of the 2020 election, an election which even Republican officials in Washington and Georgia say was not rigged. In fact, I do not think it is an overstatement to write that Trump spent over two months trying to overturn that election by any means at his disposal: legal or illegal.

    Trump’s agents actively recruited his followers to come to the January 6th rally. They brought arms and explosives with them. They constructed a gallows. They were looking for Pence, Pelosi, and Ocasio-Cortez. Reportedly, a newly elected representative actually tweeted about Pelosi’s location as she was hiding. (Boston Globe, 1/12/21, by Shannon Larson) During the insurrection, the mob itself communicated through the computer platform Parler, set up by the rabidly conservative Mercer family. In other words, all the elements of a criminal conspiracy to overturn the election by violence were there. What more evidence would one need: Ocasio-Cortez and Pelosi’s dead bodies? A noose around Pence’s neck? The floor of the Capitol exploded by an IED?

    On December 4, 1964, at Beverly Hills High School, there was a debate over the Warren Report. Mark Lane fiercely criticized the work of the Warren Commission. One of the defenders of their work was A. L. Wirin, a famous liberal lawyer of that era. During the proceedings, Lane was shocked when Wirin stated that we should all be happy with what Chief Justice Earl Warren had done, because if he had not, there might have been pogroms against the left. The idea being that the Commission was correct in its lone assassin conclusion, and the assassin, Lee Oswald, was a communist.

    Unfortunately for Wirin, and the rest of us, Earl Warren was wrong on both counts. Oswald was not a communist and he certainly did not shoot President Kennedy. Those of us who follow that case understand it to be an utter failure of justice, which had severe ramifications. That should not happen again.

    This author is not one of those who despises Donald Trump. Neither do I think he is the worst president in history. Anyone who thinks that does not realize how bad some of the American presidents really were. In fact, I actually agreed with some of his early foreign policy decisions. And I appreciate the fact he did not start up any new wars, but what happened on January 6th was a heinous crime against the American system of government. And there was no legal basis for it. Back in 2000, Al Gore actually did have an election stolen from him. He pursued every legal avenue he could to overturn the result. He deliberately refused to turn it over to a mob. When faced with that alternative he replied: “What do you want me to do, put blood in the streets?” It appears to this author that Trump and Giuliani took that alternative.

    The country needs a full, rigorous, no holds barred criminal inquiry into what happened on January 6th, one that is not afraid to reach into the Capitol or the White House. And if it was in any part an inside job, that needs to be exposed to us all. As Jim Garrison said, “Let justice be done, though the heavens fall.”


    Below is a link to an article by Seth Abramson which links the Trump family and his own representatives to a “war meeting” the night of January 5th at a Trump-owned hotel. The FBI should thoroughly investigate this lead. If it is accurate, it clearly suggests that Trump, his family, and his inner circle understood what would happen the next day. The name of Ali Alexander seems central to any real inquiry.

    RE: John F. Kennedy and Civil Rights

     

    A reader of our web site, KennedysAndKing.com, recently sent me a clip of Mr. Scarborough’s 12/11/2020 program which featured Professor Gordon-Reed. The concept of the show was to enumerate certain past presidents and what our elected president, Joe Biden, could learn from them.

    When Mr. Scarborough got to President Kennedy, he said that Biden could learn from JFK how to “brush back” on the civil rights issue, which President Johnson then had to take up the mantle on. Professor Gordon-Reed replied to this that Kennedy talked to people and eventually came around on civil rights, since he did not want events to overtake him.

    On November 22, 2020, on the anniversary of Kennedy’s assassination, a similar declaration took place. Professor Logevall made an appearance on the radio program Speakola. During that appearance, he said that, until the last year of his life, Kennedy was not really moved by the plight of those who were denied their civil rights; he added that this only came late to Kennedy.

    Prior to this, in 2018, on the CNN documentary series, The Kennedys: An American Dynasty, Mr. Jones said that JFK was not really interested in civil rights when he entered the White House and he had to be lectured about the issue.

    Going back to May of 2010, Professor Gillon made a speech at the Miller Center in Virginia, where he briefly touched on the civil rights matter. Included in his remarks, he said that LBJ did not think Kennedy was pushing the issue enough and that Kennedy did not submit a bill on civil rights until after he gave his speech the evening of his confrontation with Governor Wallace at the University of Alabama in June of 1963. He concluded by saying that it was only through Johnson’s dogged determination and parliamentary wizardry that the bill passed.

    Professor Young might be the most extreme. In a much more recent article, November 21, of this year, at the web site Truthout, he wrote that Kennedy had done virtually nothing for civil rights for almost two and a half years. Only after the Birmingham violence did he finally send a civil rights bill to Congress, which passed the following year. Further, he said JFK only did this because of the threat of economic demobilization generated by a mass movement in the south. (I admit I really do not understand what Young means by that last statement.)

    Let me begin by saying that none of this comes close to aligning with the actual record of events. And the fact that four of you are history professors makes this rather embarrassing for your profession.

    The idea of making Lyndon Johnson some kind of hero on civil rights is, to be kind, misleading. From 1937–56, Congressman—then Senator Johnson—voted against every civil rights bill that was submitted to Capitol Hill. And this was not done passively. Johnson voiced the southern shibboleth of States Rights, which meant, of course, that there was never going to be any progress on the issue at all.

    It was only in 1957 that LBJ began to change his tune on the subject. Why? For two reasons. First, he was contemplating a run for the highest office and he had seen what Richard Russell’s anti-civil rights views had done to his mentor’s aspirations. So he knew he had to begin to alter his previous voting record. The second reason was even more a matter of political expediency. The White House had sent a bill to Congress on the issue. President Eisenhower and Vice-President Nixon did not care about civil rights themselves. In fact, Eisenhower had advised Earl Warren to vote against the Brown vs. Board case. But Nixon and Eisenhower understood that they could split the Democratic Party geographically on the issue: northern liberals against southern conservatives. Johnson tried to soften the blow to his party. So, he produced a pretty much papier mâché bill. One which Senator Kennedy did not like. In fact, Johnson had to send an assistant to make sure JFK would vote for it. Later, Kennedy wrote a constituent that he hoped the Senate would pass another bill; this time with some real teeth to it.

    That Robert Caro makes so much out of this, and the 1960 bill, is a classic example of the old adage: if you have lemons, make lemonade. As Harris Wofford wrote, the newly minted civil rights advisory commission, the new department of civil rights in the Justice Department, and the collection of voting data were all pretty much useless. For the simple reason that Eisenhower and Nixon had designed it that way; and LBJ went along with it. It was all a fig leaf to disguise the damaging facts that the White House did not support Brown vs. Board and Eisenhower had allowed Governor Orval Faubus to create a weeks long insurrection at Central High in Little Rock. Wofford should know, since he was the attorney for the Civil Rights Commission.

    As Judge Frank Johnson of Alabama later said, this all changed under Kennedy. He said that when Kennedy and his brother entered office, it was like an electric current going off in the south. As noted above, virtually all of you have said that President Kennedy waited until his third year to do something, since he needed wise counsel on the issue. This is simply false. I don’t see how you can act faster than on the first day of your presidency, which is what Kennedy did. After watching his inauguration ceremony, Kennedy made a call to Secretary of the Treasury Douglas Dillon that evening. He asked him why there were no black faces in the Coast Guard parade. Dillon said he did not know why. Kennedy told him: Find out.

    Following from that, at his first Cabinet meeting Kennedy asked the members to bring in statistics on how many minority employees were in each department. Kennedy was quite disappointed when he heard the numbers. This caused him to write America’s first affirmative action executive order on March 6, 1961. In other words, far from waiting for two and a half years, Kennedy was acting right out of the gate. In a bit over six weeks, he had done what none of his predecessors had. Kennedy later extended this order to include all federal contracting and all federal programs concerning loans and grants. In other words, if you ran a textile mill in North Carolina which made uniforms for the Army, you now had to hire African Americans to work in your mill or you risked closing your doors.

    I will not go through each of Kennedy’s actions as I did the above, since this letter would get too long. Let me just list some of them:

    • The administration filed charges against the Secretary of Education in Louisiana for scheming to dodge court orders under Brown vs. Board. This was in February of 1961.
    • When the state of Virginia refused to fund local education in Prince Edward County, the Kennedys assigned William Vanden Heuvel to attain private funds in order to create from the bottom up an entirely new school district.
    • Attorney General Robert Kennedy spoke at the University of Georgia Law Day. For the first time in anyone’s memory, he spoke about civil rights in the South. He concluded by saying he would enforce the Brown decision. This was on May 6, 1961.
    • RFK did this in part to aid the Fifth Circuit Court in the South. That federal court was made up of moderate to liberal judges on the issue. He would use that court in his future civil rights cases after losing in lower court.
    • By September of 1961, the administration successfully petitioned the Interstate Commerce Commission to integrate travel between states.
    • In his first year, Bobby Kennedy filed twice as many civil rights cases as the Eisenhower administration did in eight years. By 1963, the Department of Justice had quadrupled the number of lawyers in the Civil Rights Division.
    • The Kennedy administration was the first to raise private funds to finance large voting registration drives in the south. In today’s currency, the sum would be well over seven million dollars.
    • Kennedy was the first to get the FBI to detect voting rights violations and to use that information to grant African American voters suffrage in Alabama and Louisiana. This was before the Voting Rights Act.
    • Kennedy tried to get a voting rights bill through congress in 1962. That effort failed due to filibuster. It evolved into the 24th amendment eliminating the poll tax.
    • Kennedy established the Committee on Equal Employment Opportunity, which evolved into the EEOC to protect civil rights in hiring, employment and firing.
    • Kennedy was the first to use federal contracts and grants to force private universities in the south to integrate, e.g., Tulane and Duke.
    • The administration worked through the Fifth Circuit to sue the public universities of Mississippi and Alabama to force integration.

    I could go on. Yet, just that list is more than FDR, Truman, and Eisenhower did put together. (See part 3 below) But let me add: Kennedy did not submit a wide-ranging civil rights bill to Congress after the confrontation with Wallace or after the violent confrontations in Birmingham. He submitted his bill in February of 1963. And as Clay Risen notes in his book length study of the bill’s passage, it did not owe its success to Johnson. The four major players who got it through were JFK, Bobby Kennedy, Hubert Humphrey, and Senator Thomas Kuchel. In the summer of 1963, President Kennedy began what was probably one of the largest lobbying programs in contemporary history. He brought in over 1500 people from professional groups all over the country: lawyers, mayors, and clergy to convince them to back the bill. It was the last group that Richard Russell later said ultimately forced the collapse of the filibuster.

    Further, as most of us know, it was not Johnson who got the Voting Rights Act passed in 1965. He told Martin Luther King he probably could not do so by himself. So King began the Selma demonstration, in order to give Johnson the torque to do so. And it was not Johnson who got the expansion of Kennedy’s housing act through either. He actually could not. It was the occasion of King’s assassination that allowed it to pass.

    No post Civil War president ever did as much for civil rights as President Kennedy did. That is not conjecture, it is the undisputed record. And I demonstrated it in Part 3 of my series, which I attach below. The only reason he did not pass an omnibus civil rights bill sooner is that it would have been filibustered as his narrower bill was in 1962. And it was LBJ who advised him not to even try.

    For historians and TV hosts to parrot a compilation of rightwing and leftwing myths in the place of this historical record is simply irresponsible. It is, in fact, pernicious to the public. Lyndon Johnson commandeered a ruinous presidency. Contrary to what Mr. Gillon said in his talk, LBJ could not have won the nomination in 1968. After New Hampshire, his campaign started to collapse on every leg in Wisconsin. He was given the word he was going to lose in a landslide. Contrary to what President Johnson had said, he did not “continue” what President Kennedy had begun, not in foreign policy and not in domestic policy. (See my Part Four below) He did not just wreck his own presidency. He ripped asunder the Democratic party. Staffer Carl Marcy wrote to Senator William Fulbright after the senator had discovered Johnson had lied to him about American invasions of both Vietnam and the Dominican Republic. Marcy wrote that what these dishonest interventions had done was:

    … turn the liberal supporters of President Kennedy into opponents of the policies of President Johnson, and the rightwing opponents of Eisenhower and Kennedy into avid supporters of the present administration. … We have tried to force upon the rest of the world a righteous American point of view which we maintained is the consensus that others must accept. Most of the tragedies of the world have come from such righteousness.

    It was this false righteousness that polarized the Democratic Party and paved the way for the election of Richard Nixon.

    I would like to conclude by drawing your attention to a recent article in the Washington Post. It is entitled “Hijacking the Electoral College: the Plot to Deny JFK the Presidency 60 years ago.” Donald Trump was not the first to scheme to sabotage the electoral college. The electors from Alabama and Mississippi decided not to vote for Kennedy in 1960, even though he defeated Nixon in those states. They agreed to halt their scheme to negate the election results, if Kennedy would switch positions on the ticket with Johnson. In other words: Johnson would be President and Kennedy Vice-President. Kennedy had endorsed Brown vs. Board twice as a Senator, once in New York and once in, of all places, Jackson, Mississippi. These deep southern segregationists understood who JFK was in 1960. They had seen him up close. So should you.
